The Left Hand Never Knows What the Right is Doing

We began renting a one-bedroom apartment at Windrift in Dec. 2009. Our first apartment was small but livable, and other than an occasional ant or bug problem (which is to be expected in Florida), we never had an issue. However, I would like to note that, in conversations with our neighbor - who had rented the same apartment from AIMCO for nine years in a row - we discovered that she was paying $300/month more than we were for the exact same floorplan. This made me seriously question AIMCO's ethics with regards to long-time residents. After a year, we decided to move into a larger 2 bedroom model, and chose a second floor apartment to minimize the bug issues. As we were doing our move-in inspection, we noticed that the fascia on the cabinets in the main bathroom was damaged and had been painted over to hide the damage. It was held in place with thin staples and when I tried to inspect the damage, it fell out. I asked that it be repaired at that time, but nothing was ever done. A few weeks later, we noticed that the dishwasher was basically useless, as something was rusting in side it, thus leaving stains on our dishes. We asked that it be replaced, then called again, then again. Each time, we were assured that we would be notified as soon as a workman was available to come out. We never received a call, but one day we came home to find a new dishwasher installed - no notice, no work order left behind, nothing. When I questioned the office about this, I was told that they weren't even aware that a workman had been sent out. Fast forward a year and a half. We decided to go on a long (over a week) vacation to visit friends and family. I notified the office and requested that while we were gone, the fascia as well as some other repairs be made. We made an extra effort to move our things out of the bathroom and other areas needing work so as to make the repairs as simple as possible. When we returned a week later ... NOTHING HAD BEEN DONE. I went to the office in person to complain, and was told that they would call me as soon as a contractor - not maintenance, because they are contracting to an outside company now - was available to perform the repairs. A few hours later, I got a message from my girlfriend saying that a workman was in the apartment - again, NO NOTICE OR CALL, even though a call had been promised to me mere hours before! Can this office not keep the simplest of promises?!? (The manager on duty did apologize because he "didn't think it would be an inconvenience to send someone over to make the repairs." I took this to mean "so you want us to do what we promise AND keep you informed about it? sheesh!") All I am asking is a one-time discount on the rent as fair compensation for the aggravation and inconvenience this office has caused me. According to our renter's agreement, it is AIMCO's responsibility to respond to service requests within 48 hours, which they have failed to do. I consider this continued failure to provide the contractually required service to be a breach of that contract. However, when questioned, the office denied that they owe us any recompense for their failure to uphold the contract. Apparently they would rather face a breach of contract suit than make a simple compensation for their failure to act. So be it. I'm now in the market for legal counsel. Finally, I would like to add that, despite being advertised as a "gated community," as other reviewers have noted, the gate is often broken and stands open for weeks at a time. I realize it's not AIMCO's fault that some of the less-respectful neighbors choose to drive right into the gate rather than wait for it to open, but it IS their responsibility to repair it and ensure the safety of their tenants in a timely manner. Yet another example of their laissez-faire attitude towards their responsibilities as landlords.
