On September 18, I signed a reservation form for an apartment in a complex called Tuscany owned by Ovation Property Management. I was told that there are daily fluctuations in pricing and that this price could possibly increase if I did not sign the reservation form - however, I had not had an opportunity to visit the complex due to conflicts in work schedules and when the complex management office is open. So I signed the form, paid the $50 application fee and the $300 redecorating fee, with knowledge that I would go to see the apartment two days later on Saturday when my schedule allowed. When I went to visit the apartment, it was smaller than I had anticipated, the cabinets in both the kitchen and bathrooms were covered in something sticky and there was water all over the kitchen floor (my mother and daughter accompanied me to the apartment and can confirm this). After leaving and discussing further, I decided to cancel my reservation with the apartment complex. On Monday morning, I put together the letter of cancellation (which is required in writing by the management company) and asked for my $300 dollars refunded. I was contacted by the leasing agent stating that they would NOT refund the $300 as I only had 24 hours after signing the reservation form to cancel. That would mean that I would have had to cancel the reservation prior to seeing the apartment if I wanted a full refund. I explained to management at the apartment complex and at the property management office that I signed the reservation document at 2:30pm on Thursday 9/18 and put in my cancellation at 10:00am on Monday 9/22. This is essentially 1.5 business days. However, because the office is open on weekends, they don't consider business days (the company I work for is also open on weekends and we acknowledge business days). I feel that I provided ample time to inform them that I wanted to cancel (as the original move in date was scheduled for 10/1 - so they had 10 days to relist the apartment at the date of cancellation prior to when I would have moved). Essentially, right now I have been denied refund of the $300, which means I have paid $100 per day for an apartment I cancelled due to multiple circumstances. The multiple people I have spoken to only tell me that they understand and empathize with me, but unfortunately cannot do anything for me. ***I was told on 9/30/2014 that the apartment I was looking at was the only 2 bedroom available. However, checking the complex's website today (10/1/2014), that apartment is not listed as available to rent and there are 3 two-bedroom apartments without garages listed as available. I'm pretty sure they have made the $300 has been made up and can be refunded to me.***
