A big ripoff after move out...

I rented the apt for a 13 month term. I paid my rent on time. I chose to move out after the 13 months were up. My fiancee had verbally told the manager we were leaving in May and nothing more was said. We vacated on the last day, gave our keys to the manager who promptly said "where is your written 60 day notice'" Whaaaat' "Yes, it's in your lease". I believed I had looked over the lease for all the important informaation. The only 60 day notice I saw involved the intent to leave before the lease was up. I received a bill within the week for $2,800.00!!!. I only paid $472.00 a month! There was a charge of @1250.00 for not giving notice. A "relet" fee of a month's rent. These apts are dead once school is out and they are desperate for income, apparently any way they can get it. There was a concession charge back of 800.13 I looked that up on Google and found that it is some kind of penalty that you are essentially charged back for any "breaks" they gave you at move in. I was also charged $160.00 for food left in the refrigerator and appliances filthy. I beg to differ about the appliances. There were some condiments left on the fridge door that I forgot. Not rotten food smearing the insides. The carpet charge was $105.00 (and I had paid the extra charge monthly for new carpet and vinyl)for a grand total of what amounted to half a year's rent and then some!!! This was my first apt. and I like most others thought at first blush it was a really nice place. The apt you are shown to illustrate the one bedroom apt. looks all brand new. The apt. we were originally given was uninhabitable because of a roof leak and the ceiling was coming down!! So they gave us the apt. next door. Boy that made me feel safer!! The apt we occupied had a fan blade missing from the bedroom ceiling fan, a cabinet door in the kitchen that had stripped screws in the hinges and was falling off and the "freshly painted" apt. had paint peeled off the circuit breaker box. The apt. had a generally "worn" look to it and the bathroom smelled moldy as well. We lived near the pool area and at all hours there was a lot of noise when it was being used. I requested that things be repaired and in time most were. The "security" gates are open all the time. My car had a mirror broken off and my convertible top window was ripped where someone tried to break in through the window.
I might take all these things in stride realizing that it is, after all, apt living. But to have the apts. send me a letter threatening to have a bond company come after me smacks of an attempt to intimidate the 19 yr old "kid who probably doesn't know any better". I agree with another poster who mentioned that the apt. manager is soooo nice when she is trying to convince you how nice the apt. is. After your name is on the dotted line, they couldn't care less about you. I never, not one time, had any complaints as a tenant. I was probably one of the few people who actually picked up after my dog. This place takes complete advantage of students and tries to scam them especially in the summer months. These apts are never 100% occupied. Where do they get off claiming that it will be time and expense to go through a re-leasing process when I paid my lease term. I will fight these charges with every resource I have.

to danachelle - he stated his fiancee went in to tell them they were moving out. Don't you think the idiot at the front desk might have mentioned you need to have something in writting? With all that legal moombo jumbo it's easy to overlook something. That's a pretty rude comment you said "Even at 19, you should know to read everything you sign." He said he thought he looked over the lease, what more do you want. These people are clueless that work there. I hope you don't pay them a dime pal5510.

Notice that he said he read his lease, and it didn't say anything about it needing to be a written notice - that they just needed to give notice of intent to leave. If it specifically doesn't say written, he should be able to pursue this with a lawyer. I've lived in apartments where you only needed to alert the landlord, or when you went to the office they had a form they would hand you to sign after letting them know. I err on the cautious side though. My fiance and I are moving soon, and are going to require the landlord to make a copy of the written notice with her own signature on it. I really do not trust where I live, given how they've lost several important things - like our lease when we first moved in! :P |
