i have been reading these reviews and i have to admit i did live above some smokers and it was really bad. i just kept my windows closed all the time and it made my electric bill go way up!
i never complained, but maybe i should have said something. the smoke was reason i moved and decided not to renew my lease.

On Wednesday, 12-27-06, at approximately 2 pm, I hand-delivered a letter to the leasing office. The letter documented my complaints regarding the excessive noise coming from the apt above me. I also presented a CD recording of the noise coming from said apartment. While I was speaking one of the support staff members, the Office Manager rudely interrupted the conversation. She seemed to be extremely irritated by my presence. The office manager boldly stated that she didn't care what was on the CD and went on to say that as far as she was concerned, I could have made the whole thing up! The office manager further stated that she was NOT going to evict someone for running back and forth, dropping things on the floor, or playing loud music (funny at least one of these things is mentioned in my lease as a reason to evict someone). I sat and listened as she went on and on about how I needed to prove to her that the person/people in apartment above me were actually creating a disturbance. I asked her to listen to the CD. She said that she would, but also stated that my CD was worthless as far as she was concerned. I asked the office manager where are this bureaucracy was when she sent me an unsigned 10-day notice claiming I was throwing trash from my balcony. I asked her what proof she used to send me that threatening letter. The office manager said that I called her and told her I was throwing things from my balcony. Utterly disgusted, I got up and left the office. That same evening, at 5:28 pm, I received a call from a greyclow supervisor. The supervisor seemed to be trying to downplay the issue by saying things like, "Well, maybe the kid upstairs got a jump rope for Christmas." Or, my personal favorite, "Are you sure the noise is coming from that apartment?" I started to tell the supervisor that when someone one knocks on my door, I don't run to the window and say, "Who is it?" However, the supervisor stated that they would give the woman in the apartment above me a courtesy call, "to see if she is all right". "To see if she is all right?" I thought to myself. No one is stomping and banging over her head all day and night. Of course SHE is all right! The supervisor stated that if I had any other problems to call her back and they would take it to the next level. I should have asked, "what's the next level from nothing?" Ladies and gentlemen, ask yourself one question, is this the kind of customer service you want to be subjected to? |

I have been in property management before all I have to say is BUY A HOUSE!! If you are that ---- then you should just purchase a home where you can have utter silence. Put yourself in the managements shoes, to them it looks like a he said she said... I am sure you have the option to transfer, so why don't you!! GEEZ... I remember why I am not in this career anymore.

Once again, I remind people that if they have issues with people smoking around them in apartments, they need to be pro-active, and ASK BEFORE you sign the lease papers if it is allowed. What makes you think that other people in an apartment complex do not smoke? I have yet to have seen an apartment complex that prohibits smoking in a person's own apartment. Maybe in the common areas, but not in a person's individual apartment home. And this especially makes me angry when new people move in next to someone who has been a long-term resident, and expect the apartment to change the rules just for them. If people are not smart enough to ask a simple question about smoking rules BEFORE they move in, then they have NO RIGHT to complain. It should be obvious that if a place allows smoking, then this place is certainly NOT for you. But then, there are always those few who are looking for anything they can find to complain about, because they don't have a life, and want to interfere with others and try to make their lives miserable. This almost borders on harassment!

The Modern Penal Code section 250.4(MPC) defines harassment as a petty misdemeanor if with purpose is to harass another, he/she: 1) makes a phone call without a legitimate purpose; or 2) insults, taunts or challenges another in a manner likely to provoke violent or disorderly response; or 3) calls at inconvenient hours or in offensive language; or 4) subjects another to offensive touching; or 5) engages in any other course of alarming conduct serving no legitimate purpose of the actor. (((Mmm... I guess they left out the part about complaining about being exposed to second-hand smoke. LMAO! Besides, and I quote, ???Congress shall make no law respecting an establishment of religion, or prohibiting the free exercise thereof; or abridging the freedom of speech, or of the press; or the right of the people peaceably to assemble, and to petition the Government for a redress of grievances.??? |
