Shredded check was cleared in bank - $100 Taken out of Bank Account - Northpark Apt in Burlingame

I went to Northpark (Burlingame) to see the apartments and was told that it was a good idea to give $60/Non refundable in case I wanted to keep the apartment. Then, they asked another $100 that would be refundable if I could call until a certain time (72 hours given as a verbal agreement as opposed to 24 hours written in the Lease Contract). I agreed and had a Virgin America pilot close to me given the same time frame to call.
I called before the deadline and after one day, called again to make sure that the $100 wouldn't be cashed out. I heard from Rochelle ( we are aware of this check ). I hang up and called again, at this time I heard 'I shredded the check.. Would you like me to mail it to you".. I asked for the check number and she reconfirmed to me.. So I thought,, well, everything seems to be fine.. After one week, I called my bank and the check hadn't been cashed out However, after 3 weeks, they cashed the same check that I was assured had been shredded.
I called again and talked to the manager who told me (with a supposed smile in her voice) that it 'will be very difficult' for me to prove that there was any verbal agreement given the fact that the employees have been there for a long time).
By the way the call, the information was provided (check was shredded), I want to refrain myself from believing that there was BAD FAITH,, that it was a misunderstanding... and not discrimination. I am a foreigner,, Triple Minority (Foreigner woman, divorced, Latin, with a strong accent). Funny enough is that the Virgin America pilot apparently got his check back (or at least they told him the same). After this incident, I called him and he said that they were not very helpful and seemed somehow adamant to return his check. He had to be firmer than normal and reminded them that he heard the 72 hours. More to come!
I am checking with Channel 7 (hope the owners of the Northpark Apartments help me in contacting and broadcasting this issue to Channel 7). If necessary be, I will call the attention of others by being in front of Northpark Apartments but time and money is refraining me... By the way the situation ran, I want to believe that all this happenings was a coincidence and that this never happened to other prospective clients.
PLEASE! PLEASE! PLEASE! If you know of anybody that went to Northpark Apartment and probably left a check there, let them know about this incident!
I felt bad, hurt, not to mention the fact that I need the money back in my account.
