I have not received my deposit and it's been 2 months already. I checked with rental office many times and twice they claimed they sent the deposit check already. I will give them a couple more days before I prepare a lawsuit.

Sue them. You're not the first they've done this to, from what I've heard. They either don't return the deposit at all or they levy outrageous "cleaning" charges. I was charged $250 to clean the carpet, for example -- there was one dirty area in the entry way from people's shoes. Other places would've cleaned that for $75 or less. You could make a class action out of the matter, if you could find other tenants that they did this to. And the penalties for not returning a deposit (or retaining one fradulently) are VERY stiff -- $7,500 per depositor. If you decide to, start here -- find all the disgruntled people who posted with usernames/e-mails and contact them.

I wanted to collect the deposit from the leasing office but they insisted I must give them an address to mail to. Of hand I could not remember the address and told them I will call to inform them. I emailed to them the correct address and even called them to remind them and they dare to give excuses that the wrong address was given.

Yes, I agree with the Anonymous poster above. When you send your email detailing that you have not yet gotten your deposit, CC: the Cupertino City Council AND the corporate office. I guarantee once you do that, you'll get your deposit almost instantly.

Sue them, as per california's tenents law - within 21 days after you leave the unit, the landlord must refund your full deposit, except for limited deductions which must be itemized in a accompanying notice. I send the email on 21st day with all details and tenent laws; I got my full deposit minus cleaning charges (i.e. $70) with in a weak. Do all the communications with them thru email, look at the below link http://www.caltenantlaw.com/Deposit.htm
