I resided at Emery Bay for exactly one year, I was rarely there becuase of my 12 hour work shifts. I moved in April 9th, 2003 and was out of the apartment before April 1, 2004. I provided management with my 30 day notice to vacate on May 1, 2004 along with my May rent.

I turned in my keys on May 31, 2004 and scheduled a walk through on Friday April 2, 2004.

The aparment was in excellent condition as stated by the Emery Bay employee who conducted the inspection. I was told that I would receive my security deposit ( $650.00 ) in 21 days.

Sounds all good right' on 4-7-2004 I received a letter from the management stating that I OWE them for April's rent''''' and that they have kept my security deposit and I have a balance of $599.67.

So it looks like they are penalizing me for moving 8 DAYS early and charging me for an entire month. The biggest catch is that they had already RENTED my unit before I had even moved out, I would not recommend EMERY BAY if they need to resort to such strong arm tactics. I plan to file for my deposit back in small claims and exercise my free speech by dissuading perspective tenants.
