Landlord is a thief

Sorry but I used poppaham76 previously and I can't remember password. Landlord stole my deposit. When I asked for proof of repairs she doubled the amount of money I owed her. Took her to court and she wouldn't testify. The super testified that he couldn't get the keys from me for over a week after I moved out. Also claimed damage done to the apartment but I have video. Be aggressive, don't take it to small claims judges are complete stupid. I have proof of over 30 broken laws and the video and judge ruled for them even after they contradicted their own evidence.
Staff extremely racist to non-whites. Smile in your face but never fix anything and rip you off when you leave. I also wrote the city attorney to make a complaint about how they notify you of your right to final inspection (please see below)

Mr. Aguirre,

Last week I went to small claims court because I believed that several laws, as many as a dozen, were broken by my former landlord. Despite producing documentation for all my claims and the other party appearing with nothing more than bogus documents the judge ruled in the defendant s favor.

I have major reservations about the judge s decision but more importantly I have major concerns over this injustice of the law. I believe that former landlord; Mrs. Cxxxx Fxxxxx has a system in place that is designed to allow her and her maintenance supervisor to steal the deposit money from outgoing tenants. She has been in that position for at least 10 years possibly longer. I believe an investigation is in order.

Please allow me to explain this system:

Step1. Mrs. Fxxxxx doesn t notify the tenant of the right to request a final inspection.
Step2. After the move-out Mrs. Fxxxxx doesn t make contact or return phone calls and makes no attempts to mail checkout summaries or refund deposit money.
Step3. If you are fortunate enough to reach Mrs. Fxxxxx she sends a fake summary.
Step4. If you question the summary she increases the amount of money from damages backed by fraudulent documents.
Step5. If it goes to court she and the maintenance supervisor perjure themselves in court.

Assuming you never go through all the steps she waits for an undetermined amount of time before entering into her computer the amount of the deposit that was returned to you enabling her to keep the money.

The judge refused to look at the evidence I had. She refused to look at the video which would have proved that Mrs. Fxxxxx had no merit to the damages that she alleged and as far as the ruling, I don t know how a small claim judge can over rule laws decided by the California State Supreme Court.

Mr. Aguirre this is a very simple design to see. The unfortunate thing is most of the people that are victims of this probably don t realize they are victims. I lived in Hourglass for 3 years. The tenants mostly fall into three categories:

1. Military (Can t fight for their money because of deployment)
2. Student (Can t fight for their money because they can t afford to)
3. Immigrant (Can t fight for their money because many don t understand English)

I m sure this isn t the only shady landlord in San Diego but I assure you she is taking advantage of California s most valuable assets (military, students and immigrants). Please look at the evidence that I have presented to you. Look at the laws that I have researched and please consider one thing above all else: A business has one concern its bottom line If I owed this apartment complex money, Why have I been trying to get in contact to retrieve that money from them for over 3 months with dozens of attempts and they have not made one phone call or sent one letter other than the information that I requested'

Mr. Aguirre we have an old expression down South (North Carolina) where there s smoke... there s fire. Allowing this situation to go unchecked would place current and future tenants directly into this system which allows someone that controls the amount of money deposited and the amount of money returned . This isn t and wasn t about my money. It s about doing what is right for people that can t protect themselves.

Hello This person did take us to court as a AMERICAN in the USA he has every right to do....He presented tons of evidence he thought was in his favor and all I did was testify to how he had left the apt. he claims racist, he claims the judge was unfair well all the cases were decided that day in court except ours because he presented so much the judge had to look thru it all and send us our decision..which we Hourglass Park Apts. won....Now thats why we live in this wonderful country so both parties can present there case and oh yes the judge was of Asian decent so much for the racist claim...I have worked at this complex for 15 years and we have gone to court once which is very rare you can go to www.hourglasspark.com and see our apts and our landscaping etc...In so many words this person has reported us to every organzation he could think of and we have come out smelling like a rose on every one ..but that is his right and we have no problem with that...we have residents here that have been here for over twenty years we have 144 units and we constantly are working on the upgrades and the landscaping...anyway all three of thes complaints were left by him so 1 bad apple after that many years well not bad thank you and stop by and say hi check us out for yourself

I have the exact same problem with HOurplass park apartments!!! huge roach problem, wont fix it, never calls us back on behalf of it, made us put 30 days in even due to unhabitabile reasons. Also, hit my bfs car when tearing tree braNCHES down...i repeat,,,tearing, i was walking by and they had a rope tied around the branches and pulled on the rope. didnt look safe to me, also never warned anyone parked on the street so my bfs car got a dent in it, now they saw they will fix it but its gonna take a while... i highly recommend to do your research before moving in there...they havent replaced the cupboards in years so take a look at them,, guaranteed they are all moldy and falling apart and they stink bad. I asked they guy to fix it when we first moved in adn he screwed a piece of wood on top of it!! way to get the rotted wood out!
