Warning - They Will Overcharge You on Repairs When You Move Out!!!!

I LIVED HERE FOR 2 YEARS AND WHEN I MOVED OUT, I WAS CHARGED $1100 FOR REPAIRS! THERE WAS NO MAJOR DAMAGE - JUST THE NORMAL WEAR AND TEAR ON THE CARPET AND WALLS. I WIPED DOWN THE WALLS BEFORE I MOVED AND HAD THE CARPET STEAM CLEANED. THEY STILL CHARGED ME TO REPLACE THE CARPET AND PAINT THE WALLS!!! ISN'T THAT WHAT THE MONTHLY RENT IS FOR' AREN'T WE PAYING TO "LIVE" IN THE APARTMENT, AND SHOULDN'T THAT INCLUDE NORMAL WEAR ON THE CARPET, ETC' WHAT A JOKE. ABSOLUTELY DO NOT MOVE HERE...YOU'LL REGRET IT WHEN YOU MOVE OUT.

I've lived in several apartment communities around San Diego and although each has its own policies regarding wear and tear on carpets and such, Loma Palisades has by far the most outrageous policy on their carpets. After talking with management about my carpets, they told me I would have to pay the difference on my carpets because I did not meet their proposed five year mark on the use of the carpet. I lived there for two years, and yes there is natural wear and tear on such items. I had my carpets cleaned every six months, but yet they still stuck me with the difference on my carpets. My carpets were spotless when I left. I'm sure they told the next tenant that moved in that they had new carpet. It's actually quite sad that the management is this way.

I read that it is illegal for them to charge you to paint your apartment under Cali law. I mentioned that to the office and they didn't charge me.. but they did charge us to replace our carpets which is BS but it wasn't enough to fight them over.

You have rights under California Law. I'm going through the same hassle right now and instead of paying, we're taking them to small claims court. California law mandates that apartment complexes MUST inform you of your right to a pre-move out inspection where the apartment complex is required to inform you of what you need to clean and what needs to be repaired so you are afforded the opportunity to do so before you move out so you dont get charged.
Either way, Loma Palisades Management is crap. The area's not bad, the complexes aren't completely horrendous but the management makes Loma Palisades one of the worst properties in San Diego. Sad considering they're one of the largest.

How did your law suit against Loma Palisades turn out? I'm thinking of suing them also. I was charged over $1,000.00 when I moved out because they claimed that my carpet was "filthy" and had to be replaced. Honestly, my carpet was in great condition when I left. I'm sure that they could have steam cleaned it and it would have been good as new. Any advice on how to start the lawsuit would be appreciated!

They have terrible management there and they are obviously ripping people off. I know that Kim that used to manage is no longer there and they replaced her with some other management that is just as bad...and yes I was charged for paint also and carpet. When leaving the apartment it was immaculant and they still took the whole $300 deposit and charged an extra $175. These people need to be stopped and more people need to file law suits against this apartment management. I hope people read this before renting there. DO NOT RENT THERE, IT IS A FACT, YOU WILL BE RIPPED OFF WHEN YOU LEAVE NO MATTER HOW CLEAN THE APT IS!!! What's bad...is that when I moved out, they were tearing out cuborts, floors and completely redoing the apt and they charged me for what they were going to do anyways. I am going to file a law suit also. They should not be getting away with this. It's wrong!! Whats really sad, is I am a very responsible adult...and before I moved in I saw the complaints about the apartments, and thought it was just people who didnt abide by the rules and must of left the place in a terrible mess. I still rented from them...and NOW I'm on this website reporting them.
