On 8/26/2004 I saw John at Whispering Oaks in Walnut Creek, about a 1-bdr apartment. He informed me that he needed additional information from me before we could sign an agreement. This included credit checks, my finanical background, and he would also check with my current landlord, etc. He asked me to place a hold on the 1-bedroom, and I had to give him a $30 check for a credit background check and a $250 for the hold deposit. Some of the items he needed I provided to him later that afternoon but because I had not yet filed my 2003 taxes and because I am self-employed, John told me that he would have to check with his supervisor first and then get back to me since he could not guarantee that my application would be accepted. I called & followed up with John and left a message for him on Friday but John never contacted me. John was aware that my lease with my current landlord ends on 9/11, and that I wanted to have the lease signed for 9/1 to ensure a smooth move. However, because he failed to contact me, I believed that he did not get the approval. Meanwhile, I was under pressure to find a place to ensure I am moving out on or before 9/11, and I was able to secure a place. However, when I called Whispering Oaks today, I spoke to a Paula, who told me that they would cash the $250 hold deposit because I did not cancel within 48 hours. I pointed out that I did not hear back from John and so had to make a decision. Yet, they refuse to return the $250 to me. This type of business tactic is unethical. It would be one thing, if John had contacted me and told me I could move and then I change my mind, but he never called me to confirm. He left me hanging and now I have to pay the hold deposit in full' That's just wrong. And, it seems to be a method for them to make extra money. People who move are under pressure and stress and should not be abused in this manner. Whispering Oaks has a responsibility to inform me whether the application was accepted. Not leave me guessing.
Whispering Oaks should not be permitted to make extra cash that way. They never told me, even now, whether or not my application was accepted. I have to know when I move and where I move - this is not a game. And, it's unrealistic for them to want me to live on the street just because I'm waiting and waiting for John to call me back to let me know too late the application was not accepted
