RE: Move out on Apartment 1432

Dear Kathy,

I would like to quickly resolve the payment needed on my account.

When I gave notice of my move, I wrote Peppercorn Apartments a check for the balance due, including some rather substantial penalties. This was on March 1, 2003. Since I moved over 1,500 miles away, I established new checking accounts in Pennsylvania and closed my accounts in Denver. This occurred in mid-April, something like six weeks after I gave you the check.

Apparently this check was deposited after the Colorado accounts were closed. I can't imagine the reason for such an exceptionally long delay. This check did not clear since the account had been closed. That also apparently means no NSF notification from the bank. On top of that, my computer died during or immediately after the move. All financial records including check register were on that computer. The only way I could close the account was to use telephone banking to verify the clearance of recent transactions.

Earlier this week, I received a call from a Steve Dale at a collection agency. He offered rather quickly the option of settling the account for $2,000 and I agreed to call him after work for the details.

Later in the day I spoke with my mother and found out he had called their home and misrepresented himself as a person who had worked with me in Washington, DC. When I called him back that evening he denied ever making such a call and said that it was a coincidence. He also said that you made repeated attempts in various ways to contact me, which is untrue. Mr. Dale also insinuated that the contact information I left with Peppercorn was inadeqate. I feel that his actions are illegal and insulting.

I am also highly offended that you referred this to collection without contacting me one single time. I think that I was a reliable, reasonable and cooperative tenant during my time at Peppercorn. The ceiling of my apartment was in appalling condition when I moved in and the screen door did not slide properly. I accepted that these things could not be repaired, and I did so in a very cooperative manner. There no Colorado numbers on my caller ID, and I'd imagine my telephone number does not appear on your phone bill. I've been very angry and tempted to files complaints with governments and everybody else I can think of and to write directly to Omni Properties. But that does take time and I'm not quite that angry.

On top of the offense to me, your staff's negligence has cost Omni Properties over $400 in reduced payment plus whatever you agreed to pay this agency for their services.


Since I have absolutely no faith in the integrity of your collection agency, I will not send them money under any circumstances.

----------------------------------- "MANAGEMENT" ignored my letter and simply faxed it to the collection agency. I don't think I will visit Denver again as the temptation to attack might be overwhelming. I have lived in many, many apartments and am an exceptionally tolerant person. I will call 3 times to have something fixed and never complain. But this incident was incredibly offensive and unprofessional. It figures they are under the same ownership as the Summit slum next door.
