So, I moved out July 1, 2009. I paid my rent in full and on time every single month that I lived there. On August 3, 2009 I receive notice from a collection agency that I owed Arbor Pointe money. Knowing that this was a mistake I called Arbor Pointe and told them that they made a mistake.....they refused to talk to me. They said I had to talk to the collection agency. I called the collection agency and they said that Arbor Pointe submitted my file to them on 7/31/09 and retracted it on 8/3/09. Neither Arbor Pointe or the collection agency will tell me what happened or if the problem has been resolved.

Update: 8/25/09 - Still fighting with management over this. They called me after I called everyone in their corporate office I could get a hold of. The issue is still not resolved. Collection Agency still after me. I'm considering calling the Deputy Attorney General and filing harrassment charges against Arbor Pointe.

I moved out in 2005 and just received a phone call from a collection agency even though i paid my rent in full FOUR YEARS AGO! I'm considering legal action. Please email me at arborpointesucks@hotmail.com if you have had similar problems. these practices by arbor point are totally uncalled for.

I have had similar problems with collections of this type in the past and after spending looooooong hours fighting them and considering legal action, I discovered a much simpler solution that you are welcome to share with the others on your post: First, contact the collection agency and request proof, in writing, that you actually owe the money that they are claiming. This is called 'Debt Validation' and is required by law when you request the information. This website explains the "Fair Debt Collection Act" guidelines and gives excellent instructions for the process: http://www.rebuildcreditscores.com/Debt_Validation.html This will force the collection folks to show proof that you owe the debt. Even if they have paperwork to send you, you'll be able to compare their information with your records and further dispute the collection with the apartment management. I went this route and the scumbag collection agency I was dealing with wouldn't/couldn't provide Debt Validation, but wouldn't stop contacting me soooo....... I contacted Experian (as long as the collection is showing up on your credit report, any of the big three credit reporting agencies will be able to help you: Equifax, Trans Union or Experian) and filed a formal dispute over the phone with them. They'll ask for a little bit of information and open an investigation with the collection agency. In my case, when collections couldn't provide any proof that I owed the money, Experian ordered the collection agency to cease and desist their collection attempts and removed it from my credit report. The entire process took less than two weeks and Experian did all of the work. I never heard from the collection people again. Hope this helps. I know that there are a lot of dishonest people out there trying to beat the system, but it's infuriating when you're falsely accused of owing money that you do not actually owe. Good luck! Doug
