please read your lease the pool and other ammenities are not part of your lease you do not pay for them and it is not part of your rent. Graet place to live and i plan on staing for a long time.

yes it is advertised as that but just like everything it can also change overnight without notice. and its just starting to warm up who in there right mind would swin when its been like 50 outside. you should aways read thing befor you sign fine print or not. and just maybe there is more to the pool being close than what you think you know. maybe you should be an adult about thing and bring this matter to those who can fix ot or give you some answers like call the office. i bet they never read these things so it is doing you no good. i went on here before moving here and what has been written is just not true i have found.

Tenants have rights! In addition to other legal courses of action you can call the County Health Department to enforce pool code regulations to keep it clean and to code. The management should have a good legitamate reason for the closing and the county health department will give them only a reasonable period of time to fix things. You can make your request to the county health dept anonymously. Just because is may say something in a lease doesn't mean it is legal. Property managers often intimidate tenants with their one-sided contracts with many provisions that do not hold up in court. Whoever said tenants do not pay for the pool is ludicrous! Of course tenants pay for the amenities -- their maintenance and upkeep is not subsidized by the "pool ferry."

Thanks for posting this. It's nice to know how ethical our landlord is and that there are often consequences for making unethical decisions such as cheating tenants of services. Just for the record I want to use the pool when it is 80 degrees ourside and when it is 50 I still want to use the hot tub. At several ski resorts I've been in hottubs where the temperature was well below freezing.

Can you be more specific about what is untrue? Are you implying that the pool has been open all this time? I really don't care if you like this place or not. The only thing that I care about is whether I receive the services that I pay for. I'm sure the same goes for everyone else who is upset about the pool situation.
First response:
The pool is clearly advertised as part of the experience of living at the Verandahs. While the lease may contain fine print, no contract ever provides complete power to deny responsibility. Such clauses are understandable in cases where things are unavailable for good reason and for reasonable amounts of time. Several months, however, is inexcusable. While residents may or may not legally be entitled to these services, we morally are. I am asking residents to do what they can to get the pool reopened since it will be closed for a long time if you remain idle.

First of all, to the individual who suggested calling the County Health Department. I don't really think they will be of much help if they are the ones who closed the pool down. The Health Department does not pay for repairs, so the only requirement of the Verandahs is to keep the pool closed if they cannot make the needed repairs. There is not a minimum time that they can keep it closed because they are not allowed to operate a pool that is up to code. Any amenities can be taken away at anytime. They are benefits not requirements.

You just saved me a trip. I'm not much of a pool person myself, but this thread shows a lack of concern for your tenants. I can't believe that you are publically showing how you treat your tenants. As a manager in a small business I always try to keep my customers happy whether they are right or wrong. If I was to move in, I would be more concerned about something like plumbing since the outside appearance is usually better kept than the inside. I hope your residents do get their pool opened.

If I understand you correctly, you're saying the amenities are not part of the lease agreement, nor do you pay for them. If that's correct, then it's a courtesy that the management provides these amenities at no cost and may adjust the usage of such amenities. However, I do agree, if management implies you have rights to use the amenities as a selling point prior to leasing the property, they are obligated to keep the amenities available unless stated in the lease agreement or some other valid reason.
I'm confused why the pool is not in operation. Is it for repairs or they closed it for the winter months. If the pool is closed for repairs for months on end, that's unacceptable. If the pool is closed for the winter months, that's a management decision. Have you asked management why the pool is closed? I visited the property today. The pool was clean and being used by the residents. I must say, if this is the only problem this complex has, it's nothing compared to other issues that can be a major problem. The prices are very reasonable for the location, size of the apartments and other benefits. I would definitely move in Verandahs at Hunt Club.

If the worst thing about this complex is the pool being closed, I'll move in today! I couldn't care less about the pool! I'm more interested in the living condition of the unit itself.

Has the pool been fixed? Anything else not working on the grounds; gate, dumpster, etc? I'm trying to get an honest idea of this place before I head south April 09.
