Hello my name is Josh Linney. My wife and I live in apt #1412 with our 5yr old son Eddie. When we moved in on May 28th . We were told we would have to put down $800 $100 an occyupant due to credit, and the $500 pet deposit. We signed all the documents and moved in. After numberous repairs from the movin walkthrough sheet, were refused to be rapaired i complained and they issued me a notice of eviction for not paying a pet deposit cause i never signed a pet adendum when i moved in, when i went to sign it, they charged me the $500 AGAIN, saying the $800 was just for our credit we never got in writing that it would cover the cats too. We did a walk though inspection. On the walk through the following items were noticed as being wrong. It was noted that our front door was not secure. The door jam showed signs where id had been kicked in and instead of being replaced it was just screwed back together. The front door had a brass plate fastened around the door lock to ?secure the lock? instead of the door being replaced. Our front door would not lock unless you forced the door forward and turned the lock. After locking the door is would have aprx 3/8 to ? of an inch of movement. We did not feel safe. I requested numerous times to have the front door and jam replaced with the front office with Kim, Lucy, Johnny, & Chris. I was assured the problem would be taken care of as soon as possible. After living here for almost a month the front door to apartment was still not fixed. One week I had to go out of town for business. The week before I stopped in on Mon Jun 17th. Nothing was done so I stopped in on Wed Jun 19th and was promised the door would be fixed before I left to go out of town on Thursday Night. I was emphatic about the door being replaced in time for me to go out of town so my wife and son would feel safe staying in the apt alone. While I was out of town on Fri my wife called me on my cell phone and said ?I just got home from work and the door isn?t fixed, didn?t they say they were going to fix it before you left?' ?I replied, ?yes, they said it Monday it would be fixed before I left on Thursday night?. I said it would be ok I would be home in a week. She started crying and said she would not stay here with Eddie she didn?t feel safe. She wouldn?t stay here alone with Eddie with the door like that without me. She had to go to Pembroke Pines to sleep and stay at her parents house for the entire week I was gone until the following and commute every day until Wed when I returned. We deserve to feel secure in our own home Her sons grandfather is a Pembroke Pines police officer, when he saw it he said ?You know this door has been kicked in, its not safe for you and Eddie to be here alone without Josh here?. When I returned the following Wed, I went to the office and was absolutely livid about the door. We pay $960 a month to have a home to come home and sleep in safely. For the entire week I was gone my wife and son could not do this and was forced to commute from Pembroke Pines every morning and evening because she was not able to come home. When I finally after living here over a month Lucy came and looked at the door and had them come out to fix it she stated that yes that the door needed to be replaced. So finally on Jun. 26th after being here a month the door was replaced. I inquired with Lucy about me not feeling like I should have to pay for weeks worth of the rent for that month since they were unable to stay here due to the door not being replaced and the inability to be able to safely stay in an apartment due to the condition of our front door. She agreed with me and said to write a formal letter To ?Beverly? and request that one weeks worth of rent be deducted for that month. When the service man Chris came to fix the door and I asked him if he thought I was over reacting, he said it wasn?t his right to make that call. I said do you have kids' He said yes a 15yr old daughter. I said even at 15 would you be comfortable leaving to go out of town for a week and leaving her alone if you knew the door to your house was in this condition, he ?said no I wouldn?t feel safe either?. This was denied saying it wasnt there failt i couldnt be there. Then after over 3 dozen maintenance were being put of and put off, i demanded being fixed, they were. The my wifes car was broken into and burgularized, we were robbed from our apt 2 times in a week, 4 other Apts in our building were hit, after the 5th one they handed out 'warning burgularies lately' lately. We requested out of out lease and they said we had to pay for our free month's rent we got as a move in special, the one month rent fee for breaking the lease and forfeight the *1400 security deposit we had put down. saying this wasnt a 'special circumstance'. We are moving out and suing anyone who had any of these problems please contact me or go to the website www.rentersrights.net and email me to be added to the lawsuit.
