Obscene Negligence

I moved from The Preserve about a year ago...I moved out as an excellent customer: paid in full, no late payments for the entire time I lived there, no complaints from neighbors ever.
I moved due to a series of negligent acts by the management: my roof fell in due to excessive rain, the aforementioned caused a mold problem in my apartment, I had to constantly report problems with appliances until the problem was resolved, and the final straw...I have seen others comment on cockroach problems...try some 30-50 bats living in the attic above my apartment which the mgmt(and Mid-America Apatment Communities) refused to remedy from June 2003 to my leaving at the end of Dec 2003.
We visited a friend who lived in our building there three months later, March 2004, and the mgmt had let a new tenant move into my old apartment and the bats could still be seen flying in and out of the roof at that time. So, they continued the negligance on even after having the opportunity to fix the problem after the apartment was vacated!
To add insult to injury, after I moved they refused to release the full refundable deposit of $299 as written in two of the rental contracts I had with the community. They blamed it on their own error that they had written the contracts up wrong and I had only paid a $99 deposit, even though the signed contracts reflected $299.
In closing my contract, they also took it upon themselves to supercede the 10-day period I had by law to contest the claim against my security deposit and prematurely closed MY current account with Viterra(water) then deducted that bill amount from the incorrect $99 deposit. The problem: My last water bill was incorrect, when the apartment mgmt closed my account, Viterra was no longer able to reimburse me for mis-billing since the account was closed. The apartment mgmt then mailed me a check for the difference - so what was a $299 deposit, became a $75 refund with no fault or damage caused by me. I did not accept that check based on the significant errors above, therefore $299 became $0.
After two months of corresponding with MAC(Mid-America Apartment Communities) which was the property management company all the folks in the front office reported to...I had no attempt by anyone to remedy my situation.
I spent hours writing several times to management throughout the MAC organization, I received a letter from their attorney, Robert Schupp, in Feb. 2004 stating that if I could produce a check from 1999 reflecting the deposit I paid, they would reimburse me. Even with TWO contracts stating the amount I paid, I had to come up with a five-year old copy of a check! Rediculous.
And how about the bats and their urine and feces above our ceiling and outside our apartment where they entered and exited our attic spaced which management did NOTHING about for our final six months'
This is what their attorney wrote in the same letter:
"On the third matter of concessions for problems during your tenancy, management will not agree to compensate you. The issues which you enumerated were addressed and corrected during your tenancy and no compensation will be authorized or offered."
I was one of The Preserve at Arbor Lakes repeat customers of over four years. As stated above, I was an excellent and well-paying customer. This management and the MAC company will say just about anything to get you to sign a lease and lock you in - if they could treat one of their most reliable customers this way, imagine what your worth is to them once they have your signature on a lease and your money in the bank.
