Great apartment, awful noise

When I first moved into my second floor apartment in August 2004 I just loved the apartment. High ceilings, crown moulding, nice floorplan. Little did I realize that the apartment above me was empty.
Coming home late one Friday night from a business trip and falling into bed I jumped up immediately thinking someone was trying to break in with a crowbar and a hammer. The noise was frightening. I finally realized it was just people moving around upstairs. My ceiling light fixtures shook and rattled and the ceiling itself squeaked.
Even though I have since found my upstairs neighbors to be very nice people concerned about being quiet, the noise and vibrations continue to be unbearable. It seems to be a fault of the building. I would never, never have moved in if I knew it would be like this. Stay on the third floor!
Although the materials in the apartment itself are high quality I have to give the construction a low mark because of the noise between floors.
