Title: Pool Abuse Beer Drinking, Broken Glass, Smoking in Bathroom, and Overflowing Garbage Cans

On the afternoon of Saturday, June 20, 2009, I thought I would enjoy spending time with my 2 year old child at the Liberty Park Townhomes Pool Facility. Instead, we encountered a free-for-all beer drinking party, which was remarkably one of the worst experiences I have encountered yet while living here in this community.
When we walked up to the pool facility, the security gate was wide open. This allowed uncontrolled access to and from the pool. It further negated the security card access system which is installed in order to avoid this type of problem. Apparently, the pool access gate does not have a spring retention system to automatically draw the gate closed after each opening. This is in stark contrast to the main entrance pedestrian gate which has a spring system. So that prompts the question: Why is the pool facility security access gate not equipted with a gate retention spring, in order to draw it back to its closed position after each opening'
Allowing the pool security access gate to just sway open, and stay open after each gate card access swipe, leads to the type of free-for-all access problem observed during the beer drinking party the day of this incident.
Just think if each time a guest wanted to enter the pool facility, the security access card, presumably in possession of the authorized resident, would then need to be used each and every time. This typically would not be a problem for residents/owners living in the community, however, during a beer drinking party, and presumably where many guests are invited, this would present a problem where the owner/resident would be required to get up from their pool lounge chair, or to get out of the pool each time the guest desired entrance.
That is the way it should be. It should be difficult for people, other than the resident/owners living in the community, to access the pool.
But when the gate is allowed to just stay open after one gate card access, well, then the type of free-for-all, irresponsible beer drinking, transient activity observed, is permitted to fester. What about other persons who are unauthorized to use the pool. What about small children, perhaps biking around the community, who stumble upon the opened gate' You see where this is going. The small child then ventures into and around the pool area, unsupervised, and in the worst case scenario, falls in and possibly drowns.
Getting back to the pool party. Then again, too many guests should not be the problem at Liberty Park Townhomes due to the community rules which forbid more than two guests being permitted to utilize the pool facility. A policy which appeared to be in clear violation during this incident.
It is also noteworthy to mention, that the capacity of the pool, which used to be clearly depicted on the pool rules sign, appears to have been marked over with a black magic marker which increased the pool capacity into the hundreds'
This situation needs to be corrected immediately, and anyone caught tampering with the sign, needs to be charged with vandalism, and with the cost of restoring the sign to its previous state.
Perhaps a closed circuit security system needs to be implemented in order to provide surveillance to the front gate security guards in order to closely monitor the pool facility. This would increase their awareness of any unauthorized activity at the pool, and prompt them to any emergencies which may occur as well.
As we entered the pool area, we had to navigate around some kind of Bulldog board game where bean bags were being thrown from a distance of about 10 yards in opposing directions into a wooden platform.
Now, the tossing of the bean bags was completely disruptive. As each bag is thrown, a person in the pool couldn t help but toinadvertently duck in response to the false perception that the object may hit them. It s a typical reaction, when something is tossed overhead, the natural reaction is to duck. Regardless, the situation causes one to constantly be on guard and to monitor the situation.
Then, the pounding noise as the bean bags land on the wooden platform further creates a stressful situation. Clearly, this is not something one would expected in or around the a pool area. Furthermore, as the game is played, the entire walkway around the pool becomes a non-use area due to the playing field required for the game activity to take place.
After carefully navigating around the obstacles around the pool, glass containers, such as beer bottles and tall kitchen glasses containing beer, were immediately noticed being drank from by drinkers who were both inside and around the pool.
Many drinkers were situated at each end of the pool, sitting in and around the stairs leading into and out of the pool. It is as if the pool had been converted into a private jacuzzi for the purposes of this apparent beer drinking party.
Immediately infuriating was how the beer drinkers totally disrespected the rules of the pool with the most hazardous aspect of pool violations that being the use of glass containers to consume, of all things, the most debilitating substance of all, alcohol.
Note, glass bottles and large kitchen glasses where both being consumed inside and outside of the pool.
On one table sat numerous discarded empty and partially full beer bottles, together with aluminum beer cans. All positioned precariously close to the edge of the top of the table.
Interestingly, the table was directly under a sign posted on the pool perimeter fence clearly stating that no glass containers are permitted in the pool area.
Not only are glass containers forbidden to be in the pool area, alcohol, and individuals under its influence, are also forbidden from utilizing the pool. This also is clearly indicated on the main pool rules sign located just inside the front access gate.
After finding a chair to situate ourselves in, beer case cartons were then noticed located throughout the pool area. These cartons were the type which contained the large 24 pack beer cans. I mean we are talking no small party here.
We then headed to the bathroom to change into our bathing suits. There, the garbage container could be seen noticeably full of discarded beer cans and bottles. In addition, the repugnant smell of old beer and damp cigarettes, permeated inside the poorly ventilated bathroom.
Needless to say, I quickly took care of my child and I s bathroom needs and got out of there. It felt as if we were in some nasty public bathroom at a beach, surely in complete contrast from that what you would expect in your own residential community where you spent hundreds of thousands of dollars to purchase a home. On top of which a homeowners association monthly fee is due as well.
Ready to go into the pool, my son and I then attempted to access the pool using the stair case and hand rail. These crucial areas, to enter and exit the pool, were being occupied by alcohol drinkers sitting on or standing around the steps. Again, drinking alcohol from open, glass containers. It s curious just how much beer and alcohol may have been spilled in the pool itself' Would this damage the filtration system'
My child and I stood at the top of the stair case for a moment, at the edge of the entrance to the pool, where we were not immediately noticed by the drinkers, sitting on the steps.
Perhaps due to their having been under the influence of alcohol, the drinkers were oblivious to our need to enter the pool. So I was required to request that the drinkers clear the way from around the steps and hand rail so my small child could safely enter the water.
Once my child and I were in the water, and as I assisted him in developing his swimming skills, the stark inappropriateness of the ongoing drinking, proximity of glass containers, and other forbidden activity at the pool started to sink in.
It all started to begin to dawn upon me: the drinkers inside the pool, the glass beer bottles, the talk kitchen glasses with beer, inside the pool, the garbage in the bathroom, all in violation of pool rules, community rules, and just plain old common sense courtesy and discretion.
There was also ball playing inside the pool, which further compounded the situation given the state of alcohol consumption in the area, a deep growing concern of overall safety began to become more apparent with each passing moment.
Then, it all come to toll when about 15 minutes into our swim, a loud crashing sound was heard when a beer bottle was knocked off the table and went crashing onto the pavement near the pool s edge.
The drinkers, became quite for a moment, but then someone blurted out sarcastically, Oh, oh! You know have to leave the pool area!
Meanwhile, the person who broke the bottle, clearly appearing to be under the influence of alcohol, began to try to pick up the broken glass with their bare hands.
The person later resorted to trying to wipe up the broken glass with a towel. It was uncertain as to whether any of the broken glass ended up in the pool. But for sure, a later inspection the following day revealed that not all the glass was picked up. Where glass shards were left on the pavement, creating a hazardous situation where someone could unsuspectingly cut themselves.
Well, this was the last straw, and I quickly gathered my child and our belongings in order to exit the pool as quickly and as safely as possible, being careful not to step on any broken glass.
Strangely enough, while gathering our belongings, Liberty Park Townhomes security personnel were observed driving by the pool facility in their golf cart vehicle. However, the security personnel did not stop or investigate the obvious pool drinking party ongoing at the pool. The security personnel simply drove around the looped drive way, and left the area.
Due to the considerable amount of discarded beer bottles and beer cans stuffed inside the three large blue residential style garbage cans located just inside the front access gate of the pool facility, it is apparent that the drinking activity had been going on for some time.
With respect to the garbage cans. Why so many garbage cans' Are these garbage can s even authorized in the pool area' Were they brought in to the pool area in order to accommodate the beer party' Are these garbage can s being stored there by the resident s who do not want to store them in their garages'
If they are supposed to be in the pool, does the presence of these three large garbage cans encourage the consumption of alcohol and other unauthorized activity at the pool'
At Liberty Park Townhomes, just one of these large blue garbage cans are assigned per residence, and are emptied weekly. Here, we had three, and they were stuffed and overflowing with beer bottles, cans and other alcohol consumption garbage.
Just how much garbage can be reasonably generated by traditional pool activity' Perhaps a couple of expended sun tan lotion containers, or some empty plastic water bottles.
Shouldn t these garbage cans be removed' And shouldn t anyone, or any group of persons requiring such massive garbage disposal needs when using the pool facility basically not be permitted to use the pool for such garbage generating activity'
How much money is being spent on garbage removal from the pool area' And doesn t the presence of these large, and now stuffed garbage cans degrade the pool environment by being unsightly, unsanitary, and the source of foul smells' I mean are garbage cans the first thing you want to see when entering a pool facility'
And isn t this type of garbage accumulation perhaps a violation of local, county or state health and sanitation ordinances'
Before leaving, we had to shower off and change into dry clothes. So we had to subject ourselves to the smoke and old beer stenched bathroom once again. The bathroom has no windows, is poorly ventilated, is damp, and to top it off, the door has a terrible creaking sound that occurs each time you open it.
Now if this wasn t enough, while we were changing into our dry clothes, a couple of the drinkers entered the bathroom, and one of them was smoking a cigarette the entire time he utilized the urinal. One doesn t have to elaborate on just how nasty it is to have cigarette smoke consume a poorly lit, hot, damp, musty, unventilated space. Just like when someone smokes a cigarette in an elevator.
The smell stays trapped in the bathroom. In fact, shouldn t the smoke damage be charged to the person who caused the bathroom to be damaged by the smoke' Perhaps fire detectors should be installed in order to prevent such smoking from occuring in the future'
By this time all I could think about was to get the hell out of this nasty environment, which clearly has deteriorated into nothing more than a nasty public bathroom you might encounter at a public beach somewhere.
With respect to the lack of parking. Due to the number of people occupying the pool facility, there was no parking in front of the pool. It is noteworthy to mention, that because the pool facility is located at the top of the steepest vertical street way in the Liberty Park Townhomes community, the only reasonable way to get there is by car.
Yet, there are only four parking spaces in front of the pool facility. And, in light of the pool drinking party, all spaces were consumed, except for some off limits space located in the outer perimeter of the circular turnabout. In addition, many of the vehicles which occupied the spaces at the time, did not display the required parking permit or guest pass, as required by the community parking rules.
So why weren t those vehicle stickered, especially when security had at least driven around the circular turnabout'
After escaping away from the area, one couldn t help but feel as if they had just been personally violated. The experience of having been subjected to the beer, alcohol, broken glass, smokey bathrooms, blaten disrespectful behavior, all began to sink in.
The blatant violations of pool rules by the drinkers, the overall lack of decency expected from Liberty Park Townhomes community residents or their guests, the lack of enforcement of common area rules by Team Management and security personnel, makes one feel quite insecure as if they are living in the wild-wild-west. Certainly, this is not the warm and fuzzy feeling Liberty Park Townhomes is marketed to be.
This incident raises these questions, and more like: Were these people guests' Were they residents' Renters' Homeowners' Trespassers who snuck in and played it off as if they were residents' Where was security during the entire time this fraternity style drinking pool party took place' What s up with the three large garbage can s for a pool with a limited maximum capacity of __'
Before driving back home, I stopped by the front gate security guard house to report what I had just experienced at the Liberty Park Townhomes Pool Facility.
It was difficult to contain myself, and I periodically had to remind the security guard that I was not upset at him, just generally angry that how, at this time in our community development, can this fraternity beer drinking party take place' Especially when such an event was previously reported to the property management years ago on May 30, 2006 (see CIR located at LibertyParkHomeowners.com).
Giving the security guard the benefit of the doubt, I inquired as to whether he was required to patrol inside the pool facility during their security rounds earlier that afternoon' Remember, security was seen earlier driving by, but not stopping to address the unauthorized beer drinking activity at the pool. The security guard said he didn t notice it, that he had just started his shift. He did inquire, however, whether the activity was still ongoing. I advised him that it was, and that I will be reporting the incident to the property manager immediatly.
One thing to point out regarding my discussion with the security guard. It is surprising, even if the security guard was starting a new shift, that perhaps the activity was not conveyed to him by the previous shift security guards. Surely, such hazardous, unauthorized activity would be a concern to security, and be transferred to the new shift s personnel. But, then again, the previous shift apparently was not concerned with the pool drinking activity due to their not stopping to address the situation when they were observed driving by the pool earlier.
Further questions raised by this incident: Is security even required to patrol inside the pool area' If not, why not' They surely should be required to patrol inside the pool facility during their rounds, and to swipe their bar code scan system device which establishes the date and time they patrolled through the area.
This would establish a clear system of accountability, enhancing overall community safety, security and quality of life here at Liberty Park Townhomes. In fact, if security personnel were doing their job correctly, this incident may never have presented itself, and perhaps the beer drinking pool party would not have taken place.
Upon returning home, the disturbing experience was conveyed to my wife. I then called the property management company, Team Management.
Surprisingly, Team Management was unable to be contacted directly, where an answering service responded to my call to thier office. Given the severity of the incident, and in light of the broken glass situation, not being able to directly reach the property manager was disturbing.
To top it off, the answering service said, after hearing my complaint, they would convey the complaint to Team Management on Monday, two days from the incident. In addition, the answering service representative tried to hurry the conversation along, claiming the need to answer other calls coming into the service.
Given the severity of the incident, the broken glass, the public intoxication and consumption of alcohol, in a pool environment, not being able to immediately contact Team Management, security s lack of responsiveness, all these factors expose Liberty Park Townhomes community to liability, and debilitates its resident s ability to enjoy a quality living environment.
What if someone in fact was injured, perhaps by the broken glass in the subsequent days until Monday, when Team Management would address the issue' What if one of the intoxicated individuals either hurt themselves, or other individuals, or damaged property at the pool, or was involved in an automobile accident while leaving the pool, perhaps while driving throughout the community'
At the time of this posting, Monday, June 22, 2009, 21:00 p.m, Team Management did not contact our residence to follow up with this incident . A later inspection of the pool facility revealed that glass particles were still remaining on the pavement around the pool where the beer bottle broke. The three large blue garbage cans were still stuffed, and overflowing with fowl smelling beer bottles and cans, and other alcohol consumption garbage.
The later inspection did, however, reveal evidence that someone had emptied the garbage bag, and wiped down the sinks, in the bathroom.
It s curious as to whether or not the cleaning services to the pool bathroom imposed a surcharge on the community' Is the community now required to pay for the clean up and damage sustained to the pool as a result of a large scale beer drinking pool party'
What about the garbage cans that are still overflowing' Is the community paying extra to have those cans positioned in the pool, simply to facilitate these types of beer binges' Where is the garbage going to go between Saturday and Wednesday when the sanitation company empties the garbage'
As with all community information reports, copies have been forwarded to the property management company, in this case, Team Management. This posting is also being posted here so all residents, and those concerned are aware of this situation, and are knowledgeable of who has been advised, and when.
Residents are encouraged to closely monitor the issues in this incident, follow-up with Team Management and the security company, both, directly, and inquire with them, and determine the adequacy of their responses.
Are these sevice providers responsive' Or are they evasive, defensive, or try to point a finger to the other' Should they be replaced' Are they doing a satisfactory job given the history of certain incidents ongoing in the community'

You're right...I would much rather live in a neighborhood controlled by the dictatorship of a homeowners association, one that fines for every little difference between homes. As a homeowner I am obviously not capable of making my own decisions about a property I have paid 200k for, might as well continue to feel like I'm renting. As far as the flags, every visitor I ever had thought the flags made the neighborhood adorable and fun. I enjoy the neighborhood now, but I fear that the freedoms of owning a home are gradually going to be taken away.

You were probably one of those people who contributed to the pool abuse - beer pool party. Why don't you go over to the pool, clean out the crusty stench of beer in the bottom of each of the three large garbage cans - which have no earthly business being out out the pool, unless it is to encourage more of this fraternity style, beer binge, college flags all over the place life style. You should go rent closer to GT, or other college. So practice what you preach.

Hey Uribe (Libertyparkhomeowner), you are the biggest tool bag I have ever come across in my entire life. You would function better in a communist society. You are right, you should always keep your eyes open for those scary beach balls!! I wouldn't want you to injure yourself. Do us all a favor: crawl back in your cave and shut the fack up.
