Now besides requiring you to have Renters Insurance they are trying to tell you which insurance companies they will accept.
They will refuse to renew your lease if you are using USAA or State Farm because they would not pay for the complex's damages.
Renter's Insurance is not suppose to cover the complex's damages it is the responsibility of the complex to carry the proper insurance for damage to the property.
It is funny how they mention it is the insurance companies fault that their "good relationship" with their residents is being damaged.
Here is the text of the document they are giving people as an explanation.
WAH DOES NOT ACCEPT STATE FARM OR USAA AS RENTERS INSURANCE COVERAGE
The reason that Wesley Apartment Homes cannot accept renters insurance from State Farm and USAA is the fault of State Farm and USAA. Here is why:
"There are two main reasons for having renters insurance:
1.PROPERTY COVERAGE: This is supposed to protect the renters belongings in the event of a covered incident that results in loss or damage to those belongings. (An example would be the replacement of the residents property if it was burned or damaged by an accidental kitchen fire, even if it was the resident or a guest of the resident who caused that fire.)
2.LIABILITY COVERAGE: This is supposed to pay for the property damage or physical injury to others (including Wesley Apartment Homes) when the resident or a guest of the resident is liable for that damage or injury. (An example would be the cost of repairing the apartment for damage from an accidental kitchen fire caused by a resident or by a guest of the resident.
The requirement of renters insurance in virtually all apartment leases is thus intended to be there to protect all parties: the resident, the guest, the apartment owner.. .and even neighboring residents or innocent strangers, if they are damaged or injured by the incident. Wesley Apartment Homes believes that people should care enough about the potentially catastrophic risks in life by maintaining a simple, inexpensive renters insurance policy. This is why it is required.
"State Farm and USAA insurance refuse to cover a very important aspect of these common risks:
liability for the actions of a guest. Most ordinary people believe that a well known company like State Farm would clearly cover the above described situations without hesitation.. .but they would surprised to learn that they are wrong!!
In two recent incidents, accidental fires were started in a residents apartment by guests of the resident. In one case, it was a boyfriend and in the other case it was a fiance, but in each situation the guest was not a named insured on the State Farm renters policy. Because of this technicality, State Farm took the official position that the liability coverage did not apply and refused to pay for the damage to the apartment or to the property of any neighbor.
Please understand that in these situations, the residents were still liable and responsible to pay for these damages. . .they were just left high and dry by State Farm, whom they thought would cover them. The harsh result of this narrow and uncommon approach is that the good relationship that should exist between Wesley and its resident is ruined by the fact that the resident is forced to pay sometimes thousands of dollars in damage that should have been covered by the renters insurance policy.
The same exact situation has happened on other occasions when State Farm was not the renters carrier, and in each of those cases, the other carriers paid for all the damage. The residents were therefore able to recover from an already difficult situation without the unexpected and crushing burden of this liability.
We do not know why State Farm or USAA take this position. We have strongly argued on behalf of our residents that this is not normal in the insurance industry, that it is not fair to the residents who thought they were protected... and that it is possibly not even legal. Despite these points, State Farm and USAA continue to hold this position, even though it has caused great hardship to all parties concerned.
Therefore, for the good of our valued residents.. .and to ensure that the requirement of renters insurance actually protects against the losses that occur in the real world, Wesley Apartment homes cannot accept renters insurance from State Farm or USAA.
