The concern stated in my previous e-mail has come to pass. The Paint has wrinkled, cracked and is peeling off the wall where the latest repair was made. As I questioned you regarding the repair not being made in the fashion that it was originally explained to me, I was assured through your communication and conversation with Frank that this would not happen, and the mold appears to be coming through the paint. I have attached photos of the repair job taken little more than a week after it was completed.
That being said; Please allow me to begin my response to your latest e-mail with a question.
Do you and your organization hold yourselves to the same standards that your tenants/residents are held'
I ask this question because its response is needed to understand where I am going next.
Please allow me to draw some parallels. Let me present these in a table to make them a little bit easier to understand. (Please see attached table titled Parallel Table)
Now to discuss the issues that I have had to deal with since moving into Lakeside, and the length of time involving the necessary repairs (See attached table titled Table of Issues LakeSide Apartments).
These facts being listed, let us now move on to the point.
My costs associated will all of these issues are as follows:
Lap top computer - $ 1200.00
Desk top computer- $800.00
Death of pets - $ 360.00
Cleaning of Contaminated Habitat - $ 200.00
Total of actual costs - $ 2560.00
Recompense received from original issues of stove and computer issue - $1142.00 or one month s rent at the time of receipt (October of 2007) . This still leaves me in the negative $1418.00 for actual expenses incurred due to negligent actions on behalf of your establishment. These ;of course, take in to account in no way the annoyances of having to rearrange work schedules and travel plans to accommodate appointments made with your staff to address the above mentioned issues. Most of which were pointless because they never showed up.
Keep in mind that my original request was for one ( 1 ) month s rent recompense in relation to the mold incident. Now let us do some math applying parallel fees to Lakeside for failing to meet the expectation: (these calculations apply solely to the mold issue; If calculations were completed for all outstanding issues, these numbers would be considerably larger.)
Failing to make repairs in a timely fashion (in excess of 15 days) - $630.00, we shall have to calculate this figure for every 15 days now giving you the month of original notification for free I will start calculating as of April 1st.
April ( 30 days) - $1260.00
May (31 days) - $1260.00
June ( 30 days) - $1260.00
July ( 31 days ) -$1260.00
August ( 31 Days) 1260.00
September ( 8 Days ) 80.00
Total $ 6380.00
Or if you prefer we can calculate it on a prorated amount that would be 161 days at $42.00 per day, plus the $75.00 insufficient repair fee. This totals $6837.00.
Add the Lakeside standards fee parallel costs for failing to meet the expectations to the remaining actual costs yet recouped and the total is ( again I am being generous here and using the figure generated every 15 days as opposed to daily prorating) $ 7,798.00.
This is in fact why I find the offer of $575.00 minus late fees, not only unacceptable, but INSULTING. I am obviously not behooved to accept such an offer.
As I had plainly stated in prior communications I was being both tolerant and generous when I requested one month s rent recompense for the inconveniences and inadequacies. Yet, you return to me the most insulting offer I have ever seen.
Since I have had to spell everything out for you, further wasting my time and energies I will no longer settle for anything less than 50% of the aforementioned total of $7798.00 in recompense. By my calculations, that is $3899.00.
I find that your business practices are not only deplorable, but unethical. Considering that you offer no tolerance or leniencies by way of the fees that you charge for residents failing to meet your expectations; and given the current state of affairs in this apartment community which is billed as Luxury . Luxury by definition of Miriam Webster s Dictionary is:

The situations previously discussed hardly meet the requirement of the definition - offering great ease and/or comfort, or providing pleasure and satisfaction. Especially considering buildings sinking , or completely going up in flames due to poor Construction as it was phrased to me by one of your own employees. The neighbor below me called out the fire department one night to put out a balcony fire after I ran down to tell them it was on fire, the comments the fire department expressed were that it is amazing that the whole place hadn t gone up in flames because all of the wood was rotten. This included an inspection of my own deck as the flames were coming up to it. Yet only the deck that was actually burning was replaced.
I would also like to point out that at no point in time during any of the conversations, be them written or verbal, did I attempt to gain illegal entry to anyone s home. The fact that communication appears to be an on-going issue within your establishment and organization is not an item that should affect me in any way. I should not expect to be the bearer of this burden in any way, shape or form. I appreciate your taking ownership of the issue; however, I would like to ask another question. Since this has been an ongoing issue, what is being done to rectify the deficiency'
Please feel free to pass on my contact information to your supervisor. Let it also be known that any and all communication regarding these matters is now requested in writing (e-mail is fine) as I find it necessary to have fully documented all communications with you and your staff.
Should matters need to proceed to a court of law, I have a number of residents who can share similar experiences. I find it rather difficult to believe that I have inadequate or insufficient documentation or justification for my request. Also let it be known that should this matter proceed to such a forum I will be seeking Full compensation of the previously specified amounts ( on the prorated scale) in addition to any legal fees and court costs associated.
