Canceling Application Process - SCAM

FYI - They do tell you that if you cancel to do it in 72 hours but if the process takes longer you will get your deposit back. DO NOT BELIEVE IT!!!. I was told this. I put a $300 deposit down to hold the apartment while my application was being processed. I was told it could take 4 to 5 days though (this is business days). I asked what happens if it goes past the 72 hours' Can get your deposit back' Yes, if your application is still being reviewed. A full week I had not heard anything about my application process. The only way I was finding anything out was by calling them every day to check on it. I was told every day that somebody would call me tomorrow. I never once got a call from Woodland Creek. A week later I canceled because they needed my current landlady s info, which they said they didn't need at the time I filled out the application. I did not want to give it because she did not know I was looking. After I canceled I called back a day or two later to find out when I would get my deposit back and I was told by the assistant manager that I would get it back in 30 to 60 days. I received a letter in the mail about 2 weeks later telling me I was charged a $300 cancel fee and had forfeited my deposit. I called and spoke with the assistant manager who denied everything about telling me I would get my deposit back. It was one of the other employees that told me if I canceled after 72 hours I would get it back if the application was still in process. I called corporate which is The Finger Companies in Houston Texas and I was told I signed the application and in paragraph 3 it states liquidated damages. Which can stand for numerous things. This pretty much says no matter what you are screwed after you sign the application.

What is funny now is Jamie just sent me a copy of my application and highlighted the areas that apply to me. She highlighted the section where it says if you cancel before you were approved. Does anybody else see anything wrong with this picture' On June 2nd when I called in to cancel because I had not gotten any answers she told me I was approved and now she is telling me I canceled before I was approved. They were going to keep the money no matter what happened. I am wondering even if somebody cancels within the 72 hours if you really get your money back.

PLEASE DOUBLE THINK THIS ONE BEFORE YOU EVEN SIGN THE APPLICATION.

Yeah, so typical of this place. It's like a broken record here. And waiting for them to call you back is A joke. Not only do they never return phone calls, but they also never forward messages appropriately. The staff is so uneffective. Keep in mind this community is in my estimate only half occupied and the "Management Team" can't nearly keep up. Actually I wouldn't call it a "management Team", their more like a "Leasing Team" with very little intention of managing this property correctly. Buyer beware.

72 hours to cancel is pretty standard. After that your deposit becomes liquidated damages for holding that apartment. Ummm how do you expect to get approved if you don't put all the info on your application? Sound like you were the reason it took so long. I have always found the office staff to be very helpful. Sounds like you are angry that you lost out on $300 and want someone to blame. You should always read something before signing it, especially if you are putting money down.

This is not the case. The only info I did not fill out was the my current landlady which I was told I did not need. I was told the process could take 4 to 5 days which if it did I would get my deposit back. I think this is a poor way of doing business. If I would have know I would have never gotten a phone call in that week or any type of info I would have canceled in the 72 hours.
