Unlike anything you know, the management are the WORST:
Park your visitors car, Although you have a pass in the car, wait 3 hours, GONE
Went back, asked on why it was towed, and was told you have to have visitors pass AND park in designated "visitors parking".
Here is what the "Timber Creek Resident Handbook" says in paragraph 8 (WORD FOR WORD):
Parking Regulations:
Timber Creek has a towing policy. All cars owned by residents must be registered with the office. All cars parking on Timber Creek Property Must have EITHER a Resident Vehicle Sticker, Guest Pass Displayed in the window, OR be parked in a designated visitors space to avoid being towed. Towing is done on a daily basis. Please stop by the office if you car is not registered or if you are in need of guest passes. {in Bold}Vehicles towed are at the owners expense. Any vehicles that have a flat tire, broken window, or appear inoperable will also be towed at owner's expense. Vehicles must be moved every 48 hours {End Bold}
Went to Management to ask what's up, Sister was talking, I said I was going to call the "Police", and the manager Freaked out saying I was Yelling. Apologized and continued showing my Evidence. Manager said to go sort things out with the Tow Agency.
Got to tow agency, the attendant was "Out of it", if you catch my drift. When I was done explaining, he says, "So, how do you want to pay' Credit Card, Cash...". This time, Politely asked if I could call the Cops. He Says Go Ahead. Called the Cops. Was told to come in.
Got to the Police Station, Police said he made a visit to the apartment complex while I was driving from the tow Yard. Manager said I was not at Designated area. Showed the Police Man the Evidence and the Paragraph 8 of the "Resident Handbook". He says that he does not like the "Double Talk" and it sounds that I am getting played, but I should continue the civil way: Go have another soothing word with the Management, and if it is futile, SUE!!
Got to the manager, Apologized again for "threatening to call the Cops and 'screaming'", and stopped short of going down on both knees and giving him a b_o_job. His answer to the Handbook Guide, wait for it... "Well, I don't know why you have never Ever been towed from there before (the last 8 times I've visited, I parked on the same spot, give or take 2 stalls). And you should ignore what is written on the TIMBER CREEK RESIDENT HANDBOOK. It is just a GUIDE. you didn't sign it. IT WAS A TYPO!"
Got back, clicked on apartmentratings.com to see their ratings. Sat down, logged into my account and wrote this piece. I will be filing in small claims court on Monday. I will be uploading the police report and the resident handbook later today or this week. I will post this on all sites I can. I MUST get a hold of the OWNERS of this apartment building. I will make it my Crusade to get rid of this Buffoon that doesn't know the first thing in Customer Service. Glad I got the Police Help, Good character witness.

PSS: Some of the ratings are done by staff, if you ask me. Ponder on this: Why is it that most of their GOOD RATINGS come from ANONYMOUS sources'' HUH'''
PSSS: After reading most of the comments, i'm beginning to think there is some kind of relationship between the Tow Agency and the Apartment Complex/Apartment Manager... Would like to read the fine print to see the relationship. But scratch that... Don't want to insinuate anything. Just an early observation. The case would look into that.
PSSSS: My heart goes out to anyone that doesn't consult apartmentratings.com before securing apartments. You will learn!! My sister is!!!!

I was outside chatting with a friend, and I saw the tow agency drive in and started scanning cars for towables. At about 11:56 PM, they took a picture of my car and proceeded to tow it. I confronted them and asked why, to which they replied that my tags were expired. I told him: "Look at the time, it is 11:57 PM!!!!!!!!!!!!"
Called my sister and told her to get me a new pass. He smirked and told me to my face: "Don't worry, I'll get you". So I did what any paranoid person would do. I took a picture of the new Pass that night" time Stamped and all.

I just got back from Blockbuster and sat down to watch Dateline NBC (two Hung jury before conviction for Love Triangle Murder. You got to see it). At about 10:10 PM, told my sister we needed Kettle Corn for the movies, walked outside and car was gone. Called the cops and was told it was towed. Called the tow company and was told that the visitors pass "Appears Altered".
I called the Station in Woodridge and was transfered to Naperville (the resident of Midnight towing). I called Naperville Police and was told that it happened in woodridge (see the pattern'). So when I was finally heard, I was told that it was a Civil issue. So I said I wanted a credible witness (the cops) to come take a look at the pass to tell me if it is altered and also to look at my picture I took but was told that as far as they would release my car - if I paid the tow fee - there is nothing to be done. And that they cannot even go to the tow place because 31W100 Schoger Dr, Naperville, IL is not a Naperville Jurisiction but a county Jurisdiction. Convenient! So it would ALWAYS remain, My word against Theirs. (How about the picture')
I have my evidence, right' So let me try the apartment complex again on Monday. Keep you posted...
PS: If I were you, I wouldn't bother living here... There are many other places that do not require Military Vigilance as a prerequisite for living there. That is if you are thinking of keeping your friends

I completely agree with you. I firmly believe that Timber Creek and Midnight Towing have an informal deal. I will say, however, that Midnight Towing is the worse of the two evils. They're SHADY! They've been sued before, and hopefully will be again. I had my car towed one night and even though I RAN to the truck to move it (so close I actually touched my car!), they sped off out of the lot onto Rt 53. I tried to catch up to them, but I think they pull over at the gas station @ 75th / Rt. 53 to secure the vehicle, then head over to their tow lot.

If the registered owner or legally authorized person entitled to possession of the vehicle shall arrive at the scene prior to actual removal or towing of the vehicle, the vehicle shall be disconnected from the tow truck and that person shall be allowed to remove the vehicle without interference, upon the payment of a reasonable service fee of not more than one half the posted rate of the towing service as provided in paragraph 6 of this subsection, for which a receipt shall be given."
So while Timber Creek SUCKS, Midnight Towing SUCKS MORE! Good luck with everything. I truly feel for you.

Thank you for the support. I really appreciate the help. After looking at the Vehicle code, I saw something that even makes my case stronger. The apartment Manager basically told me there is nothing he can do about it although the Resident Guide exonerated me of any wrong doing. there is an important statement in the Vehicle Code in "10:
"When an authorized person improperly causes a motor vehicle to be removed, such person shall be liable to the owner or lessee of the vehicle for the cost or removal, transportation and storage, any damages resulting from the removal, transportation and storage, attorney's fee and court costs."
I am on a mission ans thank you for pointing this piece.
Update: I spoke to the incompetent managers boss today - i.e. the Management Agency for the apartment complex:

I was told that they would investigate the Manager's response and get back to me. At least I am giving them an opportunity to correct his incompetence before I do take further action. Just in case they are not forthcoming, I contacted the Courthouse and solicited the advises of a Real Estate Attorney to seek the proper documents to file a Preliminary Injunction, based on the dispute.
I do hope they take this olive branch, because from what has been divulged to me, I could sue also for Compensatory and Consequential damages. And if from the Preliminary Investigation there is enough evidence to show that I am not the only victim, Punitive Damages might be in order - although that is a stretch.
Will update as this progresses. I would bet a million bucks that that manager thought I would just accept getting raped and fade into oblivion. Too bad, Wrong Movie!!!

We just moved out of there and are SOOOOO happy to be at our new place!!
I've had friends towed, and been towed myself as a resident, and HATE dealing with Midnight!
The management at Timber Creek is bad, but not as bad as the head maintenance moron... He tried to tell me that the mold (a 2 ft patch of black mold!! eek!) in the closet was because we had a dresser in front of it and that blocked the air flow. Then I took him outside and showed him where the foundation (at the same point where the mold was!) was deteriorating, and I said "actually I think it came from there." He shut up once he learned that I wasn't some dumb little girl, and that I actually know a little something about water, bad foundations, and dark dank places. Idiot.
I wish you all the best with the lawsuit!!
ps - I was sick for about a year, and after living in my new place for about 2 weeks, I feel fine! Coincidence????
Get out as soon as you can!
