Worst Experience Ever

We lived in Fountainhead for approximately one year and nine months. I realize that this apartment complex is over 30 years old and there will be some problems. But the experience we had with this apartment was the worst we ever had and the staff did not make the situation any easier. The problems with unit started the day we moved in the apartment. It was dirty and disgusting. The cupboards had crumbs, the oven and stove (as well as the hood above) were covered in grease, the bathrooms were dirty, the master bathtub was stained with black grime, and the carpet had black dirt ground into it over 75% of the apartment. It did not look like they cleaned it after the last tenant moved out, it didn't even smell like fresh paint like all apartments smell like when you move in. Wait, it doesn't stop there...the dishwasher was broken, the water heater was broken, the washer flooded the front entry, and the patio fence was rotted out and had nails sticking out of it. When I went to the (Director of Operations) to tell him how disappointed we were with the condition of our apartment, he told me, "well, you can move out if you want." After relocated from Grand Rapids, MI to Indianapolis that was the last thing I wanted to hear. The dishwasher was replaced, the water heater was replaced, and eventually the washer was replaced. When we went to renew our lease after our first one was up (9 months), we asked that our carpets be replaced because they were in terrible condition, which is how we found it. Instead of them replacing carpet, they wanted to give us a $300 rebate. When they first brought this idea to my attention I immediately asked, "will this mean that we will be held responsible for the condition of the carpet when we move out'" , the Leasing Manager, told me no. And I did ask more than once before I accepted the $300. The second time I asked leasing manager he said he would ask the director of operations just to be sure, again the answer was no. Over the course of us living there, mold began to grow. The washer and dryer were in what once use to be a coat closet. The door is supposed to remain open while you do laundry so that the humidity from the dryer won't get trapped in the closet but, because the dryer was not ventilated properly to the outside, it vented back in to the apartment causing mold to grow on the ceiling above the door and on the inside of the closet. They came to "kill" the mold about 6 times. Finally, they replaced the door with a louvered door; however, that didn't stop the mold from growing. The mold eventually started to grow on the other side of the wall in the bathroom. This was not the only mold problem. The dining room double window leaked every time it rained. We notified them of the leak. They caulked the window, but it still leaked. Last Labor Day when there was a massive rainstorm was when the window was leaking. All the rain helped more mold grow inside that wall and underneath the carpet. They came and "killed" that too, but it still smelled like mold. On top of that the upstairs apartment had a water supply line to their kitchen sink break, which caused a flood in out apartment. The water flooded my kitchen, but also water leaked into a closet and the second bathroom. That closet and bathroom smell like mold. All of the mold made our dog sick and he did not live with us for the last 9 months that we lived there. Finally, we had it up to our eyes with all these problems. We talked to the director of operations about just allowing us to get out of our lease with no penalty. He sent the Leasing Manager, to look at the mold. They agreed to let us out with no penalties. That decision was made within a matter of a couple of days, so we were not actively looking for a new place to live. And at that point we still had 3 months to the end of our lease agreement anyways. So even though they agreed to let us out early we stayed until the end because of our plans with buying a house falling through. It was in this last 3 months when they finally replaced the rotted out wood fence. Which was hard to believe because we argued back and forth with them about fixing it. When we told them we put the broken fence on our move in sheet, the leasing manager then admitted to us that they had lost our move in sheet. Two weeks after finally moving out I get a check from Fountainhead for only $180. Our original security deposit was $200 and the Pet deposit was $300. They charged us $320 for damages. Most of it was for cleaning the bathrooms and kitchen, which I mentioned were disgusting when we moved in. They also charged us $100 to clean the carpet. I don?t understand how they can charge us more than our original security deposit. How can they take money out of our Refundable pet deposit, when our pet didn?t do any damage' And how can they charge us for things they don?t have proof us damaging'
