Get out! File an injunction if you're stuck!

If you find yourself in any of the following situations, you can contact a legal service (if you're a student, use UMass or your campus legal help -- it's free). Keep a log of everything that happens, every complaint you make, etc. You can then apply to file an injunction to have Mill Valley release you from ALL RESPONSIBILITY for the lease. It might not work, but don't think you're STUCK IN A SITUATION YOU FEEL IS UNSAFE!!!

Here is what I experienced:

1. Security has NO PRESENCE(!!!!) except in broad daylight -- I've called at night and their answering service took a message and no one ever came. I complained at least once a week and nothing got better.

2. The apartments are filled with drug addicts, one of which was cutting herself one night when I walked in. Filed a complaint' Why would I' I don't want to get killed.

3. Drug dealers abound, and the words "n**ger", "f*ck", "bi*ch", etc., are usually screamed by the "hood's" section 8 population, accompanied with knives and on occasion a handgun. This carried on for up to an hour before I had to call Amherst police.

4. People (especially friends of residents) make it a point to double-park their expensive cars (which they bought with their welfare/drug money -- i.e., the money of those who WORK), and security does nothing to prevent it and tow them, leaving bona fide residents to seek parking far away from their apartments. The car money could easily be spent on proper child care, since the parents don't care enough about their children to watch them. Again, management did nothing.

5. As a primarily section 8 housing project, most people in the "700" section do not work, which is reflected by the screaming, drinking, and partying that take place EVERY night until ALL hours.

6. Seven (7!!!!) people were escorted out by the police during a three month period.

7. The children will vandalize your car, whether intentionally or not. My car has several dents on it where children would climb on top of it and play little games. The parents look on with disinterest.

8. The inside of the apartments is sterile and feels like a hotel -- the cheap carpeting and tiles, and dishwashers that couldn't remove a delicate snowflake from a plate.

9. The laundry facilities are sub-standard -- no hot water or hot air. I spent $22 doing laundry one night and left with wet and not-yet-clean clothes and left management a note. Their response' "Call our contractor. We're not responsible." That's the standard response you get for any complaint you file.

10. The office is not very good with paperwork and instead of adding someone to my lease, which i consented to, they put her down as a subletter against my consent and refused to drop the tenant who had moved out. This has legal ramifications!!!!

11. Everyone who lives there, except the students, is complete TRASH. They will accost you at every opportunity for money, cigarettes, etc. and then threaten you if you're white, female, or look like you have money they could steal.

How does someone file an injunction? I'd like to get out of my lease starting in June. I have documented everything that has happened here, I'm reasonably sure I could get out of it legally, I just don't know how. Thanks.

I think your negative experiences may have left you with some prejudices, but you seem to have had quite the experience. Calling everyone trash except for the students (who obviously have the socioeconomic benefit of education) is a bit harsh, but that doesn't negate the fact that you felt very unsafe. So yeah. Examine your views, but thanks for the advice and sharing your experience.

As one of those horrible section 8 persons you mention I find your blanket assumptions offensive...I completely agree with u on the poor quality of the complex.. you forget to mention that some ( note the SOME )college kids often throw loud noisy parties which keep my WORKING husband awake all hours display rude behavior and never see any reprecussions. But I would agree with u that anyone thinking about living here should run if they have that opprotunity.
