had to put my rent in escrow and the repairs still weren't made

I have been displaced from my apartment for two months because of poor maintenance policies. It started February 13 with a sewage backup in my bathroom that caused two overflows into my closet, the bathroom being inside it. The second overflow being due to lack of response on maintenance's part after several calls. I had to continuously complain to resident relations for anyone to even come take a look at the situation. When maintenance did come all he did was call a plumber and said that cleaning crew would come in the following morning to take care of the carpet and the bathroom that was soaking in sewage water. A plumber did come late that night. The following morning I went to resident relations about the carpet and reported mold growth. Cleaning crew came in and cleaned the carpet and replaced the padding. Nothing was done about my wall that had mildew and mold. I went to maintenance to report the mold. Several days later, maintenance has yet to respond. I fax a letter to the property manager regarding the issue. A few days later, still no action. I call the health inspector and right after the inspector talked to management, the manager called me back because now he suddenly cared about the issue. He placed me in a hospitality suite for 2 days while they did the "repairs." I come back to a mildew smelling closet. I ask what was done in regards to repairs and I am told they painted my wall. I mention the smell, I was placed back into the hospitality suite and "replaced the carpet, as well as the padding again." I return to my apartment to find it still smells, and other people have confirmed this as well. They then brought professional restoration to perform an "inspection." However, they refused to give me a copy of the results upon my request and snatched it out of my hands when I tried to read them. So who knows what the moisture level readings were. When I continued to complain about the smell and my concern of it being improperly taken care of for health reasons, maintenance and the manager came in to my apartment with me. To my face, they told me I was imagining the smell and that the "mold" was indeed my stuffed animals on the high shelf in my closet were shedding on just the shoe molding of my closet, and apparently reproducing as well. (duh) That's when I took it to court and filled out a petition for rent escrow. Upon the complex finding out they sent me an eviction notice when my rent was fully paid in the amount of $437 when I pay $839 a month. At that hearing the escrow account was set up and I paid into it. Throughout this process I continously received threatening late notices stating they were proceeding with legal proceedings regarding my "delinquent account." They then proceeded to continuously postpone the escrow hearing probably trying to make it so I wouldn't show or not have representation, several times changing it the day before the hearing. Once making me sit in the court room for 2 hours when my hearing was changed to the next day, which was a holiday so I had to postpone that one. When I finally got to have the hearing, I found a notice under my door stating that I owed them $2000. I go to court and talk with their lawyer. I explained the situation to him and when the property manager was going on about the repairs that were made he mentioned they replaced the shoe molding. I had before pictures showing mold eating at the wall and after pictures of a painted hole. If the molding was replaced that hole would not be there. The property manager was left with simply saying "ummm ummmmmm ummmm," which is what he says most often because he is unprepared to handle problems and issues regarding the complex. The lawyer then talked the property manager into letting me out of my lease because the manager did not want to let me out. So after being there for a whole 8 months, 2 months of which I have not been able to stay there, I have a move out date set for april 30th. However, I do not know the long term effects of breathing in the mold as long as I did. The mold, which looks like black toxic mold, had to have been behind the wall in extensive amounts in order to appear like it did so quickly. The apartment walls still have moisture problems. And upon leaving my apartment the other day there were roaches crawling inside. I do not recommend anybody move in. It's only a matter of time before it falls apart due to maintenance covering up there problems rather than using common sense and actually fixing things properly. mgFDbN4-dhkSMZ7zRmVH
