We singed a lease with Avalonbay communities on a promotion they were running,the promotion was for the first 2 months rent free with a 30 day move-in guarantee.
The leasing agent told me and my wife that if we were not happy with the apartment that we could move out within the 30 day guarantee if we signed a lease early and with the promotion our first months rent was due on 8/1/04 and if we were not happy we could move out and get a refund on our deposit and amenity fee.
This was on 5/19/04 and our lease was not up until the end of june at our old apartment and thought we could save about 1200 dollars a year moving in early, so we went ahead and signed a lease with them.
On our second trip to the new apartment which was on a sunday afternoon,we had someone put a beer bottle on the hood of my pick-up truck while me and my wife were moving stuff in to the apartment, this was vary alarming to us because we have never had anything like this happen to us at our old apartment.
Ater this we came to the conclusion that we would be better off at our old place and went ahead and gave written notice to Avalon knoll that we would not be staying thru our 30 day guarantee, the leaseing agent that we gave our written notice to told us it should not be a problem for us to get our deposit and amenity fee back.
we waited a month and made a call to Avalon knoll to check on the status of our refund and was told that we owe them money and would not be getting a refund on our amenity fee our security deposit, i told the person on the phone that we had this 2 month promotion and she told me that once we moved out that the promotion dose not apply and now we owed them for the first months rent 11 days prorated for the month of may late fees, and if we do not pay within 10 days, they will send us to collections.
we are going to pay them want they want so we will not have bill collectors calling us at our place of business and home with hasseling phone calls and plan to take them to small claims to try and recover this money which will be wrongfully taken from us in the first place.
Lesson lerned is to not trust Avalonbay cummunities management!!!!!!
