Dear Catherine;
This letter is being composed to document the events as I see them leading up to a summons to appear in court on January 8th. I?m documenting these events to prevent and warn Kay Management from any further attempts to harass or defame my character.
I consider myself a good tenant who pays his rent within the terms of the lease as evidenced by the attached. I?m tolerant of others, and do not complain. You also don?t receive complaints from others about me. What more could you ask for from a renter!
This problem apparently started in October when my records show that you received my monthly payment on 10/07/2002. For some reason I was told that you didn?t receive it or at least didn?t post it until 10/11/2002. No action was taken on your part for this one time violation.
In November I admit forgetting to pay my rent. I thought I had sent the money and was very surprised when I received your phone message looking for payment. I checked my records, and determined that you were right, and I promptly dropped a check off into your office the next morning. Upon arriving home from work I had a voice message requesting the late fee. I believe this was on a Friday and I had no intention of addressing this issue during the weekend, and made note to myself to call on Monday.
On Monday I called and discussed this I believe with Claudine and it was apparently referred to you. I wanted the Late Penalty waived this one time. I was never late before. I learned at that time that you supposedly received my payment late the prior month, and that was the reason. I was upset that you wouldn?t make an exception for a good tenant who has been part of your community for over four years. I made a decision that I was not going to fight over the $65 and I sent a request for a check to be mailed to you that evening.
Every day after that I received phone messages and notes on my door about the Late Fee. I called your office again to get it to stop. During that discussion I was threatened to be put on some list if I didn?t suddenly start paying you on the first each month. I was told to read my Lease!. Well you better read it! The payment is due on the 1st. and is late on the 10th. I elected to pay before the 10th, which is clearly within the terms of the lease.
My blood is starting to boil, beginning to feel like I?m being chased out for some reason, and I expressed that feeling to Claudine, which she denied.
You received my payment on the December 6th and shortly thereafter I was served with a summons to appear in Court. You wanted a months rent in advance! Really getting mad now! I decided to go along with your little charade and prepared for trail on February 8th.
A few weeks later I found two more copies of the notice apparently sent by your office taped to the front door of the building that I reside in. These copies weren?t slipped under my door, or attached to my door as you have always done in the past, but PUPOSEFULLY posted for others to see on the building to my detriment. Blood is really boiling now!
I took a full day off work so that I could go to court on the Wednesday during a very busy time of the year for me losing the income that I would have earned on that day and incurred $6.00 in parking fees. After waiting over an hour when I finally reached the clerk I learned that my case was dismissed. The judge must have seen that our case had no merit. Your office obviously knew the case was dismissed. Your attorney did not appear, but you didn?t have the courtesy to advise me.
Well is that the way you treat your good tenants'
Please be advised that I consider your actions to be blatant harassment and defamation. If behavior of this type continues I will file a lawsuit against Kay Management for damages that I have incurred. Furthermore, if you try to unfairly increase my rent, deny normal service, or threaten me in any other way, you will be sued. If you have reported, or plan to report anything negative about me to credit agencies you will promptly be sued. When I find a new place to live you better be reasonable regarding the security deposit or you will be sued.
For your information I have posted a copy of the text of this letter at AptRating.com along with the other nine negative reviews Village Square West has won. Your management style and the way I?ve been treated needs to be shared with others. Hopefully they will think twice before joining this community.
The only decision that still remains is if I want to be a part of this community any longer.
You certainly have a long way to go and need to learn a lot about how to treat your customers.
