Mold, bad attitudes, and theft here!!

To Whom it may Concern:
I was a resident of The Pines, Apt ---. I am writing this letter in regards to the recent incidents that have happened with renting this apartment. Since the 2nd of February, 2008 my roommate and I have smelled a fowl, chemical smell in our Apartment. We have notified DTN Management of the situation, however; we have been basically stonewalled on every occasion. Our first major problem was the garbage disposal. I was cleaning dishes in the sink and I noticed myself standing in a puddle of water about an inch or so deep. I called ------- and had to leave a message for her because she didn t answer her phone. I notified her at that time of the smell. When she called back told us that she would be over to check out the smell and would notify ---- the maintenance man about the drain. When she got to our apartment, my roommate and I were both there and reiterated the smell. She told us at the time that there was no smell, but she could get the carpets cleaned for us if we wanted. I asked her if it would be ok if I had my parents company come and clean it if the could take some fees off of our rent for doing it that way, maybe at most like $30.00. ------- said that she would find out for us. When she finally got back up with us, (about 2 days later) she told me that they cannot let anyone else do our apartment for anything off of our rent. She also stated that they are under contract with Modernistic and if they let anyone else do our carpets that it would negate their agreement with Modernistic and legally break their contract. They ended up getting Magna Dry to extract our carpets. So that was a lie as well. This brings me to our second situation. According to our lease we are to notify DTN of any Leaks, Mold etc.. Our apartment flooded on the 17th of February, not to include the leak from the kitchen sink.
When our apartment flooded, the musty, fowl, chemical smell was intensified. We called immediately to -------, then to the main office to notify the management company of the situation. We didn t find it pertinent to write a letter and let it sit in someone s office overnight while our apartment stayed flooded. The management said that they would send ---- out to our apartment to find the leak etc. 45 minutes later when ---- showed up we had moved all the furniture out of the way so that ---- could see what he had to do. Now keep in mind, my roommate and I both asked -------, -----, and both of the tenants, ----- and ----- if there were any floods in the apartment AT ALL. All of them had told me and my roommate, NO . Well since then we have paid for our own mold tests because DTN Management told us they would get mold tests done, but if they came back negative then we would pay for the tests ($500-$600). This obviously would have been through their own testing company. We have received the test results and we have found out that there is not only black mold, but another type of very infectious mold in the apartment. (We are getting another test done to find out what it is) Well in conclusion, DTN not only took our money out of our account to pay themselves without our permission for our month of March rent, but they said for compensation they would give my roommate and I $200.00. This wouldn t pay our Redi-Care bills, let alone the cleaning fees for our clothes, furniture, the month my roommate and I couldn t live there, (February) the testing fees since we actually do have mold or any other moving fees or inconvenience this has caused us. But they did offer us another apartment for $200.00 more per month plus a new Gas bill. If anyone want to see the PROOF of this willful neglegence please let me know. I am more than willing to share. Thanks DTN for this memorable experience!!

There are issues with mold at this complex, especially in the garden levels. However, because the air-conditioners aren't always draining properly, and the roofs have no eaves, water leaks have been a big problem at the Pines apartments. This is because they chose curb appeal over durability, and didn't extend the eaves to keep the water away from the garden levels. This problem can and does affect the second and third floors too, because water will get behind the siding when it rains.
There have been several incidents involving flooding at this site, and DTN has put band aids on this problem. The best bet would be to retain an attorney as this company will not voluntarily pay for your inconvenience. This is firsthand as I was a former tenant.
To be fair to DTN on one note, and this is a small one, they should have the right to use their own contractors to clean up the mess. You should also have renters insurance on your stuff as this is stated in your lease. The real concern is with your health and well-being and your loss of lodging. These are the things that an attorney may be able to help you with.

First of all, you should have had renters insurance. It WOULD have coverd your belongings. And maybe health insurance? That would have covered your doctors bill. Secondly, mold does not grow in a day or two. It takes a very long time. Did the people who lived there before you get sick from mold? I have been a resident of The Pines for two years, and I live on the first floor. I have NEVER had a problem with water or mold, and whenever I do have a small maintenance issue, DTN always sends someone over right away. They are very courteous and professional. I would recommend The Pines to anyone looking for a great size apartment with a great location!

To both of the people that wrote these responses, I did have renters insurance, the mold has to be visible for an insurance company to cover it. If anyone that reads this and has had similar experiences please email me. w8ting4eas@yahoo.com

I've lived at The Pines for 4 years on the 1st floor, and I've never had a problem with mold. I agree with the last person... you should have had renters insurance! READ your lease.
