A LANDLORD CAN ONLY ENTER FOR A REASONABLE BUSINESS PURPOSE AFTER MAKING A REAL EFFORT TO GIVE PRIOR NOTICE.

REASONABLE PURPOSE:
SHOWING THE UNIT TO PROSPECTIVE TENANTS, BUYER OR INSURANCE AGENT
SCHEDULED MAINTENANCE WORK
INSPECTION BY THE STATE, COUNTY, OR CITY
TENANT IS CAUSING A DISTURBANCE
LANDLORD BELIEVES THE TENANT IS VIOLATING THE LEASE
LANDLORD BELIEVES OCCUPANT DOES NOT HAVE LEGAL RIGHT TO OCCUPY

OR WITHOUT NOTICE IF IMMEDIATE ENTRY IS NECESSARY:
TO PREVENT INJURY TO PERSON OR PROPERTY
UNLAWFUL ACTIVITY IS OCCURRING

IF THE LANDLORD ENTERS WHEN THE TENANT IS NOT PRESENT AND PRIOR NOTICE HAS NOT BEEN GIVEN, THE LANDLORD SHALL DISCLOSE THE ENTRY BY PLACING A WRITTEN DISCLOSURE OF THE ENTRY IN A CONSPICUOUS PLACE IN THE PREMISES.

IF A LANDLORD SUBSTANTIALLY VIOLATES THIS THE TENANT IS ENTITLED TO A PENALTY WHICH MAY INCLUDE A RENT REDUCTION UP TO FULL RESCISSION OF THE LEASE, RECOVERY OF DEPOSIT LESS, AND UP TO A $100 CIVIL PENALTY FOR EACH VIOLATION. IF A LANDLORD DOESN T LEAVE WRITTEN DISCLOSURE, THE RESIDENTIAL TENANT IS ENTITLED TO UP TO A $100 CIVIL PENALTY FOR EACH VIOLATION.

There are simple ways to inforce our rights to privacy and laws against retaliation.
I have a friend who rented from the ------- and I visted that rental. I would never live here or rent form this landlord.

Dear L-- and husband. Please read your lease under the section called Management??s Right to Enter. In case of emergency, we need to enter and in this case it was a situation that we needed to get in to take care of right away. Please go back and refer to the section on your lease that you were given when you moved in and to the other copies we gave you when you lost your original and other copies. We only enter without notice if there is an emergency which in this case there was. We also discussed it with you after we had taken care of the situation. We hope you are happy in your new place and wish you the best. WLA
