Approximately one year after leaving Wayzata Woods Apartments, I received a threatening letter from Barbie jo Kalash. The letter was sent by certified mail with the misleading return address of 600 Rice Street, which is the only reason I signed for it. In this letter, Barbie threatened me with charges of trespassing and calls to the police if I were seen by ANY one for ANY reason on Wayzata Woods Property. MINNESOTA STATUTE 609.605 TRESPASS states "A person is guilty of a misdomeanor if the person intentionally...... occupies or enters the dwelling... without claim or right or consent of the owner or the CONSENT OF ONE WHO HAD THE RIGHT TO GIVE CONSENT, except in an emergency." According to legal counsel, RENTERS have the right to invite guests to their homes, which are considered their rental property, even if their home is part of a larger apartment dwelling owned by another. Furthermore, invited guests are granted easement to the dwellings of the renter, WHO IS ONE WHO HAS THE RIGHT TO GRANT CONSENT to enter. Lastly, court cases have confirmed residents have the right to grant access to buildings, even if the management states otherwise.
