This recent letter should explain things well enough.
I was a resident of you Waterford Village property in Durham, NC. During my stay there, my apartment flooded 3 times, eventually warranting your property manager to hire contractors to replace drywall and baseboards because they were rotting.
During these times, I incurred additional costs to power the fans, dehumidifiers, construction equipment, etc.... I was never reimbursed.
I moved out on October 2nd, 2008.. This is January 25, and I have not yet received my security deposit. I have spoken with the staff on multiple occasions, and they repeatedly inform me that they are undergoing management changes, etc.. and that things have slipped through the cracks.
The State of North Carolina has a law governing security deposits, that you must inform me in writing of any allocation of funds, and provide me with any balance due within 30 days... obviously we are well over that mark.. and I will be actively pursuing this with my attorney starting Wednesday.
You have 72 hours to respond. This is a simple $200 security deposit that is going to cost you quite a bit in Attorney's fees, as well as a possible class action if this is representative of how your properties are handled.
