I cut and paste the following from the North Dakota AG's web site. Dakota Park and Park Avenue are owned by the same company and both consistenly violate this statute.
The part about normal wear and tear is the violation.

The security deposit and an itemized list of any deductions must be returned to the
former tenant within 30 days of terminating the lease. The landlord cannot withhold
money for normal wear and tear to the property. Interest on the deposit must be paid if the landlord holds the deposit for more than nine months.

The landlord also overlooked the fact that the carpet was beyond it's life expectancy.

I understand that you are upset because you were charged for carpet damages but I assure you that lime green stains on the carpet are not considered "normal wear and tear" by any company and that normal high traffic discoloration or furniture marks would be considered normal wear and tear. If residents do not have any damamges, they will get their full deposit plus interest. ~Dakota Park Managment
