After dealing unsuccessfully with the apartment manager I wrote to her supervisor the following:

Dear ****
I was provided your e-mail address from the 1st Choice offices in Texas with hopes of informing you a concern that I have. I have been a resident at Avalon Hills Apartments for the last year, and first I would like to compliment you on your property. I have enjoyed my stay and wish I could remain a tenant but due to the cost I can not. With that being said, I wanted to inform you that I was upset with the interaction that I had with -------- (property manager) on 10/21/08. I was confused about the process needed for me to vacate my apartment and called the Avalon offices to get clarification only to become more confused and disappointed that a combination of assumptions on my part, and messages received from the previous management team, that I had not fully understood the process to vacate and would have to pay an additional cost due to the poor timing of my notice.



------ (Property Manager) delivered the news of the additional cost very straight forwardly and a little bit too fast for me (of no fault of her own) the first time I spoke with her. I called back to get clarification to which I felt ----- became very short and defensive. She cut me off, and didn't listen to what I had to say, thus leading her to respond to what she assumed that I was asking, making the interaction even more frustrating. At this point I did inform her that I felt she was being a bit defensive, and informed her that I just wanted to offer some feedback, that I felt like I was mislead by the previous team, and that because of that I was having to pay extra money and go through something that could have been avoided if the fact that a 30 day notice, needed to vacate at the end of your lease (due to it automatically going to a month to month after the end of the lease period) was stressed more, to which she again was defensive telling me that I signed the lease, asked me if I read my lease and that she does stress it when tenants are signing the lease. To which again I addressed the fact that I felt she was being defensive, as I was attempt to stress the fact that there was a different team in the management office at time that gave a different run down to myself and my roommate when we signed our lease.



After feeling I was not going to be productive with ----- I ask for her supervisors name and number, to which I didn't get, and was questioned as to why I wanted it, and what I wanted of ----- that I couldn't get that I thought I would get from you (her supervisor). Again I stressed that I just wanted to give feedback to hopefully help someone in the future not be in my position to have to pay extra if they too, have been given a different message from the previous management team, and not to solely complain about -----, which unfortunately this message does contain.



Unplanned financial burdens are a part of life to which I feel as though I am able to handle, but it was very upsetting to have the information delivered with the above mentioned interaction with -----nyder. My roommate and I chose Avalon Hills due to the interaction that I had with the previous team, they presented to be very pleasant and down to earth, leading us to decide against a different complex with more amenities and space.( the current team upon introduction to the community also presented to be very pleasant and down to earth, and had not raised any concerns about them from our part until 10/21/08) . This chose is now a regret of ours after trying to offer feedback to help fix a possible communication problem resulting from changes in management that ---- so rudely reacted to. I digress to say that I am hoping to help others. That other tenants who started their lease under the previous team, may have poor information, that could lead to them having to pay additional cost, and possible leaving with such a bad memory of Avalon Hills. That maybe sending out a memo with the lease renewal notice reminding them that they need to give a written notice to vacate prior to there lease being up, reminding them that the lease that they signed will convert to a month to month lease if there is no written notice, could help ease possible future problems of your consumers.



----- was unable to be open to that bit of feedback, but I hope that you will, and something positive with come out of this disappointing and frustration situation.



I understand that you are in Omaha this week and will be in the Avalon Offices, and I will attempt to follow up with you in hopes that this e-mail hasn't been misunderstood, or to see if there is anything that could be done to rectify this situation. Please feel free to reply or call if I have done a poor job with communicating my concerns, and something maybe confusing or unclear. The contact information listed with Avalon is still current.


This was the response from the Supervisor from there Coporate office:

Dear ------- (me)

Thank you for your information and I apologize for any misunderstanding that may have occurred when the previous staff reviewed your lease with you. I will certainly forward your concerns to ------- and remind her and the current staff of the importance of a thorough lease review when a resident moves in. Though it is important that the staff review the lease with a resident it is also the responsibility of a resident to read their lease thoroughly when they sign it. When a lease term expires it continues to remain in force on a month-to-month basis and all terms of the lease apply including the 30-day written notice to vacate requirement.



We understand that people s circumstances change and we are sorry to lose you as a resident. Hopefully my response has answered your questions and concerns. Please feel free to email me with any further inquiries and we wish you well in your future endeavors.

I completely agree, and understand. I lived there for 2 years, and the new manager ----, is IMPOSSIBLE to get ahold of, and when you do get ahold of her, she tries to get rid of you ASAP. I had a problem with them (COMPLETELY their fault), and had to contact 1st choice in Texas myself, but had a somewhat better outcome. After so I was treated much different (positive), but should have never came to that, especially with the proof that I had!!

The management of Avalon Hills are incredibly rude. ------- is, by far, the rudest apartment manager I have ever seen. How long will she be allowed to treat residents with no respect and disregard. She even slammed her office door in my face before. A person of her character should not be working with the public; she should be assigned a cubicle, working ALONE!
