I have lived in Fox Meadow from October 2001 to the present (March 2004)
I have not really had any problems up until now. The end of January 2004 some new people moved in above me. A young hispanic couple and their small boy. They have been blasting their bassy music and TV non stop since they moved in. I have complained at least 5 times, written and verbal, to the property manager, Jean Scafide, and she refuses to do anything! That is a violation of the lease! They are breaking the law and don?t even care!! I then sent a letter to the parent company, Kamson Corp., and they wrote back w/the most unprofessional and ridiculous letter I have ever seen! I am moving out of here on April 1st because of this mess. They are trying to charge me a $710 "breach of lease" fee. They violated the lease, not me! I have abided by the rules my entire stay here and I have paid my rent on time EVERY month! On top of all this, they raised my rent $25 each year. I just went through my paperwork from when I moved in and I found a nice addendum to my lease that says my rent would be DECREASED by $25 if I fulfilled the original 1 year lease. Well, they owe me $600 now!! I?m going to talk to them to see if we can work this out amicably and peacefully, but if not I guess I?ll see them in court. I refuse to allow them to screw me over when I know I am in the right. I have done much research on the laws and have everything needed to back myself up. My rent went up and nothing else changed. This place is not worth the money. I pay $710 a month for a small 1 bedroom apt right now. Only thing that is included is water! What a jip! The light outside my door has also been out for a couple months now. I guess maintenance sleeps all day!! The walls here are PAPER THIN. You can hear your upstairs neighbors walking around and talking like they were right next to you!
After 2 other times of going in and her not being there I got to speak with her, BJ Mitchell, today.
She was VERY rude and talked to me like I was born yesterday.
She said she is going to speak to the regional manager about the "breach of lease" fee they are trying to stick me with to see if they will let me out of my lease. I then told her I am moving because of their lack of action on the noise upstairs and that falls under constructive eviction. She got silent for a second after I said that. She also told me that their $710 "breach of lease" fee will come out of my security deposit. They have another thing coming if they think they are gonna keep my security deposit. Isn't it against the law for them to do that anyway''
I also showed her the addendum and explained, according to what it says, they owe me $600. She then tried to tell me that I was given the discounted price and the extra $25 was just their annual increase. So in other words, according to her, I was given their "discounted" rate and they just slapped their annual $25 increase onto it that everyone gets. She's full of crap. That addendum says just what I told her. That my rent should have gone down $25 not gone up at all...period. So I just told her that I know what it says and I didn't come to argue.
So I got nowhere with this woman. I had to leave before I went off on her.
I'm not paying them a dime and if they do not mail me my security deposit within 30 days after I leave I will take them to small claims court. They, apparently, think they are above the law.
Do NOT move to Fox Meadow under any circumstances! You will be treated like crap and your rent will only go up!
