This has been a three year battle, I have won in court vs. Fox Run twice and they still send me letters from collection agencies, this was my letter to the judge.

FYI, If I was homeless and Fox Run offered me a place to stay, I would pass.


Actual Letter:

This letter is in regards to my lease agreement with Fox Run of Plainsboro, New Jersey.

When I moved into apartment 20-09 I signed a six month lease for the specific reason that I would not live in New Jersey past the month of June, 2002. My lease was from January 2002 until June 30th 2002. The option of signing a six month lease with Fox Run was the only reason that I chose to live there. When deciding to move to New Jersey, I was conducting my search from Massachusetts over the internet and with numerous phone calls. When I discovered Fox Run I was thrilled to know I only needed to sign a six month lease. This would be perfect because my job at the time was with the Trenton Thunder (Minor League Baseball) and it would end after the month of August. I had already made arrangements to stay with a co-worker the final two months of the season. When deciding between a six month or one year agreement with the Fox Run office I specified I wanted the six month option because I had no intention of living in Plainsboro past June 30th. This is never mentioned by Fox Run, it is conveniently ignored in all of Fox Runs reports.

During the last days of June when I was making arrangements to move from apartment 20-09, I went into the Fox Run office to hand in my keys and let them know that they could inspect the apartment for a return of my security deposit, the manager of Fox Run told me that there was a problem. I was then informed that according to the lease agreement I did not give them the requisite sixty-day notice that I would be vacating 20-09. This was a surprise to me because since day one of moving in I told the office that I would only be there for six months, I gave them notice one-hundred and eighty days notice. I then was asked if I received a letter taped to my door two months ago reminding me that my lease was ending and to notify the front office of my plans. I replied that I had never seen a letter taped to my door regarding my lease. The manager responded by saying Well thats not important, you still owe us for two extra months. I certainly feel like its important, as I have had to deal with this two years removed. The manager continued to tell me that I would owe two extra months rent at market rate (An increase of $700 to $1000) and since there was no lease for the next to months I would have to pay an extra $250 a month, totaling a two month fee of over $2500. I was then asked to sign another contract agreeing to this fee, I refused. The refusal to sign this agreement has been conveniently left out of all reports filed by your office.

Three questions to consider.

If a letter that could potentially cost a tenant over $2500 is so important, why is it taped to that tenants door instead of being mailed' And why did the manger dismiss it as unimportant in my conversation with her' Because she knew that they made a mistake by never asking me of my plans, although I told the office of my plans to only stay there six months because of my odd work schedule.

Why would anyone sign a six month lease if they planned on staying somewhere for a year' The tenant who stays longer then their lease states should have to pay extra not the tenant who lives up to the terms of it.

If market value increased 50% in six months how hard was it to find a replacement tenant' The market value reflects demand, this increase obviously shows a great demand for Fox Run Apartments at the time, I am sure they were able to get a tenant in 20-09 to start July and never suffered a loss due to their unorganized nature of forgetting the schedule plans of tenants and forgetting to remind themselves with a flawed system of scotch taping important documents to an apartment door.

I will not pay any of the requested amounts, and I am filing a small claims countersuit for the $700 security deposit which was never returned, and conveniently never mentioned in any of Fox Runs claims. I am also taking inventory of items of mine that were ruined due to water damage from a busted water pipe during my stay at 20-09.

I would like this matter resolved as quickly as possible, or perhaps a term Fox Run is more familiar withwhenever convenient.
