Yo!

WHY DID THEY RENT ME A DISABLED UNIT'' I AM NOT DISABLED!!

***I ORIGINALLY WROTE THIS OCTOBER 2003***

When I found "The Boulders" apts I was so excited to be moving to what I mistakenly thought was going to be a great place to live. It didnęt take months, weeks or even days for me to find out that I would be forced between a rock and a hard place by the office personnel. The day I signed my lease and moved in I found a series of major discrepancies in my Apt unit versus the model apt. After several hours and many phone calls to the office staff I was informed by them that they had leased me a "DISABLED" unit. I thought, "Why did they lease me a DISABLED unit when I am not DISABLED' Arenęt they suppose to lease these units to DISABLED people'' What if a "DISABLED" person wants to lease an apartment here''' Apparently, at the Boulders they just doesnęt give a damn because my nightmare had just begun. I had put in numerous written requests followed up with numerous phone calls for maintenance and after living here for over 6 months I am still waiting for approx. half of my original (11 pages) of requests for maintenance to be completed. There are 2 "conditions materially affecting the saftey of ordinary persons" in my unit yet it has been over 6 months and I am still waiting for these 2 problems to be taken care. During the past 6 months numerous things had come up that required attention and maintenance has not been here once to take care of anything I needed (with the exception of the day it rained cats & dogs up here, they kindly stopped by with their shop vac to suck the water out of my carpet. I literally had water coming in my front door and believe it or not there were several areas in here where the water just came up through the ground soaking the carpet. I have never seen such a thing. Little did I know that when I first moved and it was finally revealed to me that I was leased a "DISABLED" unit not only was it called this because it was accessible for a "DISABLED" person but also because the apt. unit itself is so jacked up and in need of repairs. I have been WAY MORE than patient, I have given them MORE than ample time to complete these mainteneance requests and I had also given them "permission to enter" my apartment if I was not home yet still I sit and wait.

Since I moved in here 6 months ago I have seen this complexęs common areas go from good to horrible. There are days that the pool leaves something to be desired I donęt know maybe.....CHEMICALS would be a good start! I guess they are also conserving electricity because they used to have the pool lights on at night but they havenęt had them on in many months leaving the pool area really dark. There are 4 Propane BBQ grills (2 by each pool area) People use to always be BBQing everyday and then we couldnęt anymore because all 4 BBQ grills DO NOT have an ignitor button anymore. The areas need to be swept for it has become the "hangout" for the overpopulation of GIANT FLYING COCKROACHES not to mention the cockroaches that don't fly that we have living here at the Boulders. They also must have decided that the trash doesnęt need to be emptied from this area even though it is overflowing out the top of the garbage can. I guess they would rather please the cockroaches instead of the tenants. The landscapers must be invisible cus I have never seen one. This must explain why the ground cover around the buildings is so overgrown that people have gotten tripped up by it and complained before anythng was done. I guess for all these reasons I have just listed above MUST be the reason they have INCREASED MY RENT $90 per month after only living here 6 months!!!!! Because it certainly is NOT because they have kept up the common areas in such a superb way nor is it because they have done an outstanding job with my "disabled" apartment by responding to my maintenance requests. As a matter of speaking my apartment has literally become more disabled due to MGMTs negligence in regards to my requests.

What ever happened to being legally bound by the lease agreement'' In my lease there is even a paragraph dedicated solely for the purpose of explaining AMENDMENT, BINDING EFFECT, AND ACKNOWLEDGEMENT. It also states that, "OWNER SHALL ACT WITH DILIGENCE IN MAKING REPAIRS". Should I maybe have dropped off a copy of a dictionary at the office because I have to assume that the office personnel does not know the meaning of the word "diligence"!!

I have not defaulted in any way in regards to my lease for if I had you know I would be held completely and totally responsible for defaulting. So why is it that the "owner" can do so and get away with it'

Do yourself a favor unless you are a glutton for punishment and desire extreme aggravation and stress on a daily basis save yourself from heartbreak and an overpriced, undermaintained apartment complex whose office staff just doesnęt give a damn.........when you see The Boulders at Lone Mountain just keep on going!!!!
