Sublease
(n) when a tenant let out the whole or part of the property rented by him a to a third person it is called 'sublease'. Even though it is rented out fully, the first tenant will be responsible for payment of rent and all charges to the landlord and he is also responsible for all loss caused by the sub lessee to the property. There is no agreement with the landlord and the sub-tenant. The landlords generally discourage such subleasing by banning it in the lease agreement. 100 MAIDEN LANE ALLOWS FOR SUBLEASING AS WRITTEN IN THE LEASE.

Right on? First of all, there are fees to have a sublease from the lanlord, and the building is allowed to deny anyone you bring to the table to sublease your apartment because your sublessor has to go thru the normal approval process with the building to get approved to sublease your apartment. So for example, if 100 ML wants to be pricks all day long, which they are anyway, they can just keep denying your sublease applicants for whatever reason they want. Credit, no rental history, or because they just don't want you to sublease your apartment and make up any old excuse. Not to mention, you are legally bound to pay the rent to 100 ML, so if your sublessor decides not to pay, you have to pay for their rent. Eviction genrally takes 4 - 6 months if you try to get a tenant out of an apartment for nonpayment, so you run a massive risk for yourself by subleasing because you have to pay that rent until you get them out, and there is a chance you won't recover the lost money thru the court system, which is greatly in favor of the tenant and not the landlord (and you are the landlord in the scenario of you subleasing your apartment to someone) plus let's not forget those lovely attorney fees on top of your lost rent. And lastly, what does being able to sublease have to do with anything anyway? Anyone who is in this building and dislikes it, why would you want to put someone else thru what we're all going thru? Let management be the bad guys and lie to tenants to get them in here. No need to stoop down to their level. Instead, let's all start doing something to fix this horrible situation.
