My name is Je Gyun Chon who lives in 5422 Bermuda Bay Dr. Apt. 3C. (Island Club on Columbus Ohio)

I am a doctor and came from Republic of Korea on March, 2003 and I have lived in Island Club.
However, I must move out on march/31/2004 because my researches finish on next month. (My lease is due to expire in Mar/31/2004.)

So, I gave a written notice to manager of Island club office on Feb/06/2004. , I gave a minimum of at least 55 days written notice before expiration of my lease to vacate on expire date.
However she made additional charge $131.50 to me for my 5 days delayed written notice.
I think that $131.50 is a penalty. But she said that $131.50 is not a penalty and it is only 5 day rental fee through a 60 day notice.
I never understand about she''s additional charge ($131.50).
If she request additional charge to me, she must have a proper reason and legal basis. However she did not. Only it is a habitual practice.

In accordance with our lease contract, your company require that the lease term be fulfilled and that lessee provide a minimum of at least 60 days written notice of lessee intent to move out on or before expiration of your lease. However, there is nothing about additional charge (penalty) when I give a 55 days written notice. Although they request the 60 days written notice, I have also a right to refuse about it. And I have only agreed and signed to the lease contract, I never agreed and signed to she''s habitual practice.
If she makes additional charge based on the lease contract and legal basis, I will pay. But she did not.
So she''s demand is an abuse of she''s authority and illegal act.
I don''t think that USA is an illegal country.

In accordance with our lease contract, community management will provide a positive and timely move-in and move-out experience.
Community managements of other company remind lessee of expiration of his lease if it come close to expire date. They repeatedly send to lessee by E-mail, mail, telephone or a slip of paper. If I receive the penalty when I give a delayed written notice, they must notify me that there would be a penalty. However, community managements of Island Club never send to me. Also when I gave a oral notice of intent to vacate, they never said of written notice.
Why dose she neglect the she''s duty'

1) Why does she''s company give me a penalty (additional charge; $131.50) about my delayed written notice'

2)If she gives me a penalty, what is a proper reason and legal basis of penalty'

Why must I pay the unreasonable demand'
Could you explain above my question'

Your lease agreement under "Notice to Vacate" states 60-day written notice. You gave a 55 day notice so you are responsible for the 5 days of prorated rent. How freakin hard can that be...duh.

Here's the problem I have with Island Club, they approved this guy to live here without him even being able to speak English and he probably took a wonderful, hard working, American's Job.

I wonder if it is the office staff that is being that mean. Those are horrible things to say to someone who is just asking for and explanation. What horrible people.

He didn't take a job away from someone. He took a research position at a Univeristy. Its not like he took a job that Annon would have gotten.
