THEY PUT ME IN DEBT and "nothing can be done"

The Villas at Little Turtle- BAD. I recently turned in a post-dated check (5 days early). I have lived at this AIMCO facility for two years and have always paid my rent on time or early. The manager took my cheque and cashed it at Chase Bank on N Hamilton Road. I get paid on the 1st of the month, and since I have little money in my account, the $960. payment dug my account in the hole. I NOW OWE OVER $300. IN FEES!!!! (and is growing) AIMCO (Villas at Little Turtle) says this is in no way THEIR FAULT! That's funny, because their MANAGER, just told us it was HER MISTAKE. She showed my husband a stack of post dated cheques sitting in her drawer ready to be cashed. HOW and WHY was only mine cashed' I spoke with my bank and they told me that CHASE should NOT cash post- dated cheques. I have spoke with the manager at CHASE BANK and she told me they could not look at every cheque. CHASE BANK should not cash a cheque that is POST DATED! THIS IS ILLEGAL!!!!!!! We keep calling but no one is calling us back, they are completely avoiding us. TWO MISTAKES and I'm in the hole just because I wanted to be a good tenet. AIMCO and CHASE BANK need to own up to their mistakes and handle them appropriately. I am completely at a loss and would just like my FINES PAID!

The only illegal activity I see is you writing a check on a bank account with insufficient funds. I can't imagine how you think this is someone else's responsibility to hold a check for you. Perhaps you should have waited until the money was in your account before you wrote it. I do have sympathy for you b/c I think we have all probably been in a situation where you have to "beat a due date" before payday. HOWEVER, I also believe that everyone knows that this is a gamble.

UPDATE: Dear Anonymous, it sounds like you work for them. If so, shame on you. Dear Dampiera, you sound human, thank you. I was going to be out of town on the 1st, therefore I wrote the cheque and turned it in early, since there are fines tacked on, if the payment is made after the 1st of the month. The AIMCO- Village at Little Turtle Managers (and THEIR Managers) NEVER RETURNED ONE of OUR PHONE CALLS. We called endlessly, to no avail. When we spoke with them face to face, it was always; "Being resolved".."We're taking care of that problem"...with a lot of smiles but NO ACTIONS to help the situation. The Manager at CHASE bank told us it was our problem since we did not hold a bank account with them. (I did not realize tenets had to have an account with their apartment complex's bank). She went on to say that, "CHASE only looks at the cheques from THEIR clients...no other banks, and that, it was our bank's fault." Our bank has nothing to with any of this mess!!! CHASE NEVER OWNED UP TO THEIR RESPONSIBILITY! FINAL REPORT: WE WERE $650. in the HOLE and so glad to LEAVE AIMCO's- VILLAGE AT LITTLE TURTLE and WILL NEVER BANK with CHASE. LESSON LEARNED!!

You're welcome :) I misunderstood, I thought that Chase WAS your bank. Your bank should NOT have "paid" the check until the due date. At the LEAST they should have bounced it back. However, I did some research and found that apparently policies and laws have changed in the past 10 years or so (I haven't used checks since then lol) so you may not have any legal standing. I would suggest that you a) obtain copies of both Chase and your bank's policies regarding postdated checks, b) look through your lease paperwork for any written information stating Aimco's or V@LT's post dated check policy, and c) consult with a lawyer. MANY lawyers will give free advice on things like this over the phone. If you can't find one, check your employee benefits at work and see if they offer a legal referral service as many of them do. I guess the last thing that I would suggest is to send a certified letter to your apartment communities office detailing the situation (who you gave the check to, when and why) and include a copy of your bank statement showing the check clearance and the NSF charges as well as a copy of the check itself showing the date written on the check. I would THINK that you would have a LITTLE legal standing considering that this office clearly holds post dated checks on a regular basis. There's clearly a precedent here. It's easier to avoid a phone call than a certified letter. You might also look into using your bank's online check service. You can tell it on which date you'd like the check to be delivered, give the name and address of the payee, and they guarantee to pay it on the date due if you give them the required notice. Good luck, LL101. I'VE certainly learned a lesson in reading and researching this!!!!

To be clear, it is not illegal to cash checks that are post dated, because legally the date has no meaning. It is purely for personal records. I was in the same boat once, but my personal finance professor, who worked in every department of banking, let me know that legally, the date makes no difference, and unfortunately, someone has 6 months to a year after a check is written to cash it. Its crappy I know, and most of us have been there, but this is not a legal issue, and you really can't blame this on the apartment complex, if even they hold post dated checks, they're doing you a FAVOR.
