Worst apartment experience ever...

On June 10, 2006, I moved into a 1 bedroom/1 bath apartment at Red River. Even though I knew the location wasn??t the safest, the price appealed to me. As a broke college student, I was happy when the assistant manager, Elyse Emery told me that she would lease the apartment to me for the rate of $312/month. We discussed each part of the lease, and signed and dated it.

On June 12, 2006, I was walking down the sidewalk outside of Apt. #1007. The area was poorly lit and I stepped over a crack in the concrete and fell over a big tree root in the grass. A friend carried me up to my second story apartment because I was unable to walk on it. The following day I went to a foot and ankle specialist who verified that my foot was broken. I was put into a cast for the next 5 weeks. I was then put into a walking boot (which I was instructed to not put any weight on) for the next 4 weeks. I was on crutches for a total time of 9 weeks. During this duration, I lost my job at a grocery store, and had to temporarily quit my job at a tanning salon. With no income for 10 weeks, I was still expected to meet my monthly rent of $312.

On the night of July 31, 2006, in the apartment parking lot, my driver??s side car window was busted out. My $200 radar detector was stolen.

I paid my rent on July 31, 2006 (1 day early) for $312. I received 2 notices (8-7-06 and 8-8-06) at my door telling me that I had a balance of $140.16. ($100.16 extra rent fee, and $40 late rent fee). These notices made no sense, so I talked to the office staff twice, both times they told me they would take care of the problem, and that my balance would be $0. I received a call from Elyse Emery on August 8, 2006 telling me that my rent was $369/month. I stated that $312 is the amount that we agreed and signed on the lease, and that is all that I could afford to pay. She then told me that she would get the lawyers involved and would immediately begin the eviction process. (She then hung up on me). My only other options were to terminate the lease and get my $50 deposit back, or sign a new lease for $369/month.

I decided that the best option would be to terminate the lease and get my $50 deposit back. Along with being unable to walk or work, I am in school and am now having to find time to move. The staff treated me in a way that made me question Case and Associates completely. I have never been treated so unfairly, or talked down to as though I was mentally handicapped. I am perfectly capable of reading a lease and I understand the meaning to the term ??legal binding document.?? The staff should not be able to change the price whenever they wish.

Safety was also an issue for me. Along with getting my car broken into, I never felt safe outside/inside my apartment. One evening, I had to call the police because two men were smoking marijuana and urinating on a wall outside my apartment. There were constantly men outside drinking alcohol and loudly playing music. The parking lot was always filled with trash and glass.
