This is a follow up to a previous negative posting. We lived in Fountain Park for 6 months. When we originally moved in, we told management that we would like to upgrade to a unit with a washer and dryer. We actually decided to leave after noise issues with our neighbors and after finding a quieter duplex. So it was alway our intention to vacate the unit we were in and that's why we kept our apartment immaculate. We didn't even hang a picture, let alone cause any marks on the wall. Our carpet was perfectly clean...When we did the walk thru, the manager's assistant said "It's like no one even lived here."
When we received our deposit back, they had removed $150 for carpet cleaning and repainting. I addressed this with management, who have admitted that the apartment was perfectly clean when we left. Linda, the manager, used the old excuse, "It cost us more to paint than we charged you, so you should be happy" excuse. I don't buy that crap...
I don't understand why they chose to repaint an apartment that didn't need to be repainted. I actually question whether it was really done or not. Anyway, the point is that you will not get all of your deposit back no matter how well you take care of your apartment. According to the contract(in which the language is vague about their wear and tear policy), they will decide how much to bill you if you live in the complex less than 18 months. The contract says they will charge you only for "excessive" wear and tear. Linda claims that this also covers "normal" wear and tear. According to the Oregon State Bar website, a landlord can NOT charge you for normal wear and tear. I have yet to decide whether or not to pursue this matter in small claims court until I get more information. I will follow up on this site if I do sue.

I hope you followed this suit up in small claims court! I lost all of my lease and then was charged an additional $200! I am a responsible person with a professional career and my apartment did not have anything above normal wear and tear. It is such bs that they charged me above my deposit!
