Please keep in mind when you look to move to any property managed by Guardian Management that they do "preventative maintenance" inspections yearly. They give you a notice that anytime during the period of one week, they will enter your apartment whether you are there or not with one management staff and one maintenance crew staff and search your entire apartment, including closets. It's an incredible invasion of privacy but they pass it off as "looking for items in need of repair". I tend to think this is not legal ... the POLICE need a warrant to search your apartment but the management does not'

The notice they give you has a section to list needed repairs. I have experienced several of these inspections and none of the items I have listed on the sheet have ever been attended to.

Illegal search! Management says it's legal as long as they give you 24 hour notice, but I still say they need a better reason than "preventative maintenance inspection" to search through your entire apartment.

Unfortunately this teneant is mistaken. Since they are not the owner of their apartment, the owner is entitled to conduct maintenance inspections, as long notice is properly given. They are not "searching" the apartment, but following a checklist developed to document the condition of certain things such as a working smoke detector, water heater temp, and whether there are any safety issues such as items blocking heaters, to name a few. Upon request, I am sure that the checklist can be reviewed by a concerned tenant. There are 2 parties involved so that no one is alone in a unit during the inspection.

Although the landlord maintains legal title to the property, the tenant has use of the property and it is considered the tenant???s home with regard to the right of privacy. As noted earlier, the landlord has the right to inspect the property, however, at least 24 hours notice must be given before entering the property, except in case of emergency, agreement to the contrary or unless it is impracticable to do so. The rental property must be safe and sanitary and be maintained throughout the rental period. If repairs are necessary for safety or sanitation, the landlord must make such repairs without cost to the tenant. The condition for repair can not be from tenant neglect or a deliberate act.

This is OREGON STATE LAW.

If the resident did NOT get satisfaction for maintenance issues, they should have requested again, or gone to the manager's supervisor for assistance. To some extent, if things were not addressed in a timely manner, it is the tenants fault as well as management. This person is clearly misinformed.
