Keep in mind the following guidelines when trying to obtain your security deposit after your move:



1. Provide proof of your new forwarding address. This proof can be in the form of a letter sent certified, return receipt.



2. Designate a certain amount of money during your stay at Home Properties for the express purpose of being used to recover your security deposit in district magistrate court after your move. DO NOT expect(if you do, you are suffering from grand delusions of a potentially incurable nature) to receive the security deposit within the 30 day maximum time frame mandated by PA state law and clearly indicated in the renter?s contract. The amount of money you designate for the above-mentioned purposes depends on your comfort level and whether or not you choose to have an attorney represent you when you bring suit in district magistrate court. You will, however, be entitled to sue for double the amount of your security deposit if you did not receive it within 30 days, assuming you provided proof of your forwarding address at the time of your move-out. At minimum, you will need $50 for the initial filing fees and $20 if you want the summons to be hand-delivered by a constable. Also, consider time taken off from work to appear in court. My husband had to use coveted vacation time for this purpose.



3. Once your case is heard in front of the district magistrate and the case is awarded in your favor(which it was for us!) HP will then have another thirty days to file an appeal or submit payment. Based on our experience, they will do neither, in which case, you will need another $143.00 to file an order of execution to recover the settlement you were awarded.







4. Check out the billboards at area supermarkets and other public establishments if you are in the Malvern area. You will see the date and time of an upcoming Notice of Execution Sale. This will ,hopefully, be the last and culminating step of a lengthy "move-out" process that begun at least four to five months earlier.
