BEWARE! Want to get out of your lease legally'

I was a staff member for a year and a half and a former tenant during an undisclosed ammount of time. I was told by upper management to post comments on this site to up our ratings. We had to be anonymous. That's why SOME of the postings sound like commercials. Making sure they have all the amenities stated.

Some of the people on staff are pretty much as hellish as the unhappy tenants stated. But the majority of the staff are just trying to do their jobs and the owners of the Commnity have not given them the means to do it. As long as I can remember this property could not pay the bills owing pest control companies all over town, not being able to get parts for maintenance issues.

If you have to live in this community due to $$ issues you may have, I would stay clear of basement units. Most of them have flooded and had MAJOR mold problems. If you have moved into an appartment and seem to not be able to shack a cold have your apartment checked for airborne mold spurs. (it should be free at DHEC)Be careful.

If you can't get anywhere with managment, call the owners of the community. they do not like mold scares. If you feel your apartment is uninhabitable get it in writting through fire marshall or Dhec and go to magistrates court and file a constructive eviction. That is were you are taking management to court and getting yourself out of your lease LEGALLY. MAke sure you document everthing (take plenty of pics) and you have to give management 14 days to make things better in your apartment. You also have to send it to them in writting. I would suggest certified letters as correspondence. Get a copy of the land lord tenant act study it. And just have your moving truck ready when you go to court.

1. document all maintenance request and date they were fixed
2. get fire marshall or dhec to deem unit uninhabitable, take pics
3. send certified letter to management to fix issue or you will leave
4. after 14 days if nothing has been done (started to fix the issue) go to magistrate and file constructive eviction
5. wait for court to send letters and send you a court date.
6. be prepared in court, have everything documented and pictures. Don't repeat law to judge, they know what the laws are, and they hate slumlords. Just tell them you need to move asap. If you have been ill make sure you have doctors receipts prescription and so on.

When you get a copy of the Land Lord tenant act know what you are doing back and forth. If you do not understand what it is saying I would get a lawyer. It would be worth your state of mind and health.
