BAIT AND SWITCH BIG TIME!!!

Long story short, I am out my $100.00 deposit, but I am going to fight to get it back. Here is the long story:
I, my fiance, and my current roomate looked at a 3 bedroom with garage, and we loved it. It was mid-September at the time. We explained that we would love to live there, but our lease wasn't up until the end of November. They said no problem, we just had to put a deposit on an apartment that was due to vacate at the end of September. So we picked an apartment (a VERY nice location, no freeway noise) and put the money down. A week later I checked on the applications (they were approved) and nothing more was discussed. I assume then that everything is going as planned.
Late October, we went back to take another look and make sure everything was still okay, and we are given the keys to view our now empty apartment, problem is, it isn't the one we put the money on! Instead, it is the one nearest the freeway. The tenant at the other one we had the deposit on decided not to move out (note we put the deposit in MID September and the tenant was due out at the END of September). NOBODY bothered to tell us, and now we are being told we have to go the other one, and OH YES, since it is past the 72 hour application/deposit cancellation, I dont get the $100 back.
Ofcourse, I was upset, and they did offer an apartment with a "premium" view (swamp with fountain) for the base price, but that was one of my original choices and I didn't choose it.
We thought about it, and decided not to live there, yet they still insist I dont get my deposit back.
I knew fine print, I read it. Technically yes, I dont get the deposit back, but I feel this is a bait and switch so that should void the language.
