I am a resident who was also towed recently because there is nowhere else to park at the estates.

The towing company they use, Superior Automotive Towing located at 4842 Elmore Memphis TN 38128, is guilty of predatory towing practices. They try to charge a total of $200 ($125 for towing, $25 per day storage fee, and $50 administration fee).

This is illegal in the city of Memphis. According to the Memphich City Code section 6-88-6 Any towing and storage firm engaged in the business of non-consent towing shall not charge the owner of any towed vehicle or personal property in excess of one hundred twenty-five dollars ($125.00) for the removal of a vehicle or personal property or in excess of thirty dollars ($30.00) per day for storage fees. The one hundred twenty-five dollars ($125.00) shall be all inclusive; no additional fees may be charged for using dollies, trailers, lifts, slim jims or any other equipment or service.

They can not legally charge more that $125 ($30 per 24hrs the vehicle is in their possession). This company also refuses to release vehicles so that they can charge extra storage fees. If you are towed by this company contact the City of Memphis Permits Department at 636-6711 and speak with Sgt. --------. The city is currently involved in litigation with this towing company. You can contact the City of Memphis attorney's office at 576-6614 to confirm this as well. You should also consider filing a civil claim to recoup the illegally charged tow fees. You will easily win.

When the apartment complex was notified of this the manager did nothing but talk about how her lawyers had talked to their lawyers and everything is legal, which clearly it is not. This is unacceptable and I will also be bringing this to the management company's attention.

My apartment complex uses this company as well, they are crooks.
