I don't even know where to begin.
I lived in a one-bed apartment in May of 2007 and everything was ok. One of the maintenence guys at the time was my friend so anything that I needed fixed was well taken care of. When my lease was up, I decided to move into a two-bedroom and that is where all hell broke loose.
First of all, the apartment was funky. It smelled like old fart throughout the entire apartment. Then, I walk to to bathrooms and the cabinets are nailed shut. They left me without an oven-rack for an entire month so I could not cook a meal. And THEN, they still didn't give me any kind of credit. I asked to move out into another vacant apartment, but they refused to do so claiming that there was none left, when there was one available right next door to me for another 2 months.
Oh that's not it; I get a knock on my door from the lady downstairs telling me that there is a leak coming from my apartment. I look and my old, nasty, filthy hot water heater is leaking, which caused my floors to stink even more and my walls to crack and mildew. It has been about 6 to 7 months since that incident and my walls still look the same.
I moved into my 2-bed apartment in May of 2008, therefore, I just KNEW that my lease was about to be over. I just called about 30 minutes ago to find out that my lease is up on April 8 and they're telling me that I will have to sign another lease or pay a month to month charge. Now that's that B.S.! Donnna just told me that she will have one of the leasing consultants call me back to let me know if I can go ahead and move out, but when I call now, the phones just ring and ring. Caller I.D. is somthing else. I'm not staying there any longer and I will fight to get out of there. What they don't know is that I work for a law firm in downtown Memphis, and if I can't get out of there, River Trace is going down!

I will join in as well. I really think you should do it. It might make a difference there. I threatened them anytime I needed something done... It was the only way to get anything done. I finally got out of my lease without penalty. Later, they sent a bill to my forwarding address claiming it took 1800 dollars to cleanup my apartment, so my credits didn't cover it all. LOL. I treatened again... and haven't received any other correspondence since. They know better, they're just gonna see what you let them get away with. I know the legal system better than they do. Take lots of pictures before you move or they'll claim you tore up the place... seriously!! I heard Pam Perry and Tonya Mosley are out, which is good. But the new ones arent any better. NICE! Trade idiots for more idiots. This property will never recover from its bad reputation. People who read these complaints and still lease there need to be slapped, LOL.

This is how to get out of your lease without penalties: their is a clause in the lease that states that you must deliver to your landlord a WRITTEN notice to fix items that are hazardous to your health (heat leaking, air conditon leaking water, burst pipes, stove not working- the things that in the lease that Mid America states that they will provide in good working condition), and get a deadline of 30 days to repair or make you lease null and void. Then only then will you have a leg to stand on in court. The reason why I know is that I once was in court when a young lady was telling the judge about the condition of her apartment as for why she did not pay her rent, the judge look at the horrible pictures and the apartment complex admitted to not fixing the items but her downfall was that she did not served the complex in written of her request (have it certified mail with required signature so no can say they did not get it- Donna lies ALOT!) and she did not moved out. The only thing is that the pictures shows a bad place put she never moved out just withheld rent and the judge rule in the apartment complex favor due to her not understanding the lease. It is quite simple, if they provided it too you then it must be in good working condition, call the health department to have your apartment inspected for safety, call MLG&W have it inspected it, if Mid America comes back to you and state you can not do that show them in the lease, possibly page 4 in the paragraphs of what they will provided shows that yes you can (provided that you put the rent money in an escrow account showing that you have the money for the rent until items are fixed). If you need more help contact HUD Fair Housing Department on the sign in the leasing office or Rental Rights.
