Mold in apartment

My husband, our 4 month old daughter and I were all set to move from Florida to Nashville and into Brentwood Downs. The lease was mailed to us to sign, but since we could not get it notarized, the contact at the leasing office said she'd have us re-sign it once we moved in. So technically, we were not bound by a contract yet. We did however pay all the fees associated with moving in. We arrived on Sunday June 10th to find that the guest toilet had overflowed and soaked the bathroom floor, then went under the wall into my daughter's bedroom closet, and into the hallway and part of the livingroom. However, we didn't quite know the extent of the damage until we had already unloaded half of our stuff. The leasing office was closed, but we were able to page the maintenance man. When he came, he said one of HIS guys messed up by not installing a part on the toilet correctly, which is why it overflowed everywhere. He then went on to say it was no problem and he'd just put some fans in the apartment to dry it out and it would be good as new. My husband actually pulled up part of the carpet to find that not only was the carpet soaked, but also the pad underneath AND the hard floor. We decided to load up all our stuff in the moving truck again and go to a hotel. My husband and 4 month old daughter have severe allergies and we could not take a chance of moving into that apartment. After speaking to the leasing office the next day, we were told that the apartment was in great condition to move in, and that all the damage had been taken care of. My husband explained that if the water had soaked as much of the floor that it did, it most likely went under the bathtub as well, and that could not be fixed by "drying it out with fans". Our concern, which we explained to them, was the development of mold. The leasing consultant insisted that the maintenance man said it was "fine". We told them no thanks. They have a policy of refunding your money if you don't like their community, and they did send us most of our money back. But they witheld the rent for the last two weeks of May because they were holding the apartment for us during that time and could not rent it out to anyone else. My point is that if the maintenance people would have done their jobs correctly to begin with and installed the part the right way, and inspected the apartment before we were scheduled to move in, this could've been avoided. They admitted it was their fault, then refused to work with us. So obviously they didn't need us as tenants. We ended up having to live out of a hotel for 3 days, pay an extra $100 to keep the moving truck longer, and pay a little over $1000 to our new apartment complex for moving in fees. And we had already paid Brentwood Downs almost $900 for their move in fees, and we wouldn't get our refund for 6 weeks. Needless to say this has set us back a GREAT deal.

I completely agree. You're better off not moving there. My boyfriend and I moved across the country and didn't know much about BD until we already signed a lease and moved here. The apartment was so much smaller than they claimed and absolutely not worth the rent. We stuck it out for a year but I was miserable every day! I hope you found a better place!
