BENT TREE TRAILS -- SHOULD YOU SUE
The application for Brion Enterprises cable services -- delivered by Sabre -- which are the only cable services available at Bent Tree Trails, requested personal identification information including social security number, driver's license number, name and date of birth and as defined by Texas Identity Theft Enforcement and Protection Act of 2005, Tex. Bus. & Com. Code Ann. 17.41, et seq., and the Tex. Bus. & Com. Code Ann. 35.48.
The application is found in your packet of information provided by Sabre upon completion of leasing document and is required to be fully completed in order to secure cable television services at Bent Tree Trails.
After seeing this information in the hands of the installers I made an inquiry of Sabre regarding this course of conduct. I asked a member of Sabre management to whom I was speaking would she hand over her personal information to the installers. There was a noticeable (and laughable) dodge. Then she assured me she had known Brion for twenty years and she had complete confidence in ALL their employees.
Brion gave all personal identification information to the installers --two cable guys in a truck. This was standard procedure as admitted by Mr. Brion in a recorded conversation.
When I asked not to be required to furnish this information I was advised by an employee of Sabre that if I wanted cable all this personal information was absolutely required. IT WAS NOT OPTIONAL.
In providing this information it is my opinion and position that Sabre Management Company is acting as an agent for Brion Enterprises in securing this information which is forwarded to Brion Enterprises.

On March 3 and 4, 2009, I have made arrangements to meet with representatives of the Public Utility Commission and the Texas Attorney General's Office to discuss what I perceive to be a crucial course of action against Saber Management acting as agent for Brion Entrerprises and against Brion Enterprises for unsafe, unlawful and egregious practices regarding personal identification information.
This is a cause of action every person at BTT has if they completed the form for cable from Brion Enterprises provided to you by BTT and I urge you to follow my lawsuit on my blog, observe the outcome and take your own course of action.

RESPONSE TO MELMISO -- I am sorry I cannot post below. I have included my response here.
First, I want to thank Melmiso for providing the opportunity to address these issues.
With regard to the pet deposit your point is very well taken. On a personal note, I had rugs over my apartment and never saw a pet stain on the white carpet. However, if your logic were followed then there would be no pet deposits but rather Pet Fees.
Certainly, this is a point of discovery. How were the pet deposits escrowed and accounted for by the Defendants. And how many of these pet deposits have in fact been returned over the last seven years.
If these Pet Deposits are in fact Pet Fees which statutory and common laws are violated' We believe this to be violative of at a minimum the Texas Deceptive Trade Practices Act and fraudulent conduct.
Second, with regard to the personal information being shared with the installers please be advised that Federal and State Law clearly addresses this issue. Perhaps your concerns there should be addressed to the United State Attorney s Office for the Northern District of Texas and the Texas State Attorney General s Office. These are the parties responsible for interpreting and enforcing this law.

This is not a law suit undertaken lightly. I fully understand at least one defendant may be required to seek the protection of the Bankruptcy Court. This is a very serious matter and far exceeds a $600.00 deposit. I suspect legal fees here will well exceed $100,000 for the parties involved.
When I advised onsite management that I intended to file a lawsuit her response was "Fine." I assume she had the authority to speak for the Defendants.
