The FCC outlawed cable exclusivity at apartment complexes last fall. This week the U.S. Court of Appeals upheld that decision.
Has anyone tried to have cable from a REAL cable company installed in their apartment?
The revenue sharing agreement between Brion Enterprises and Sabre management is now ILLEGAL. OVER BY LAW. Has anyone here been informed of this fact or are they still trying to get one by one you AT YOUR EXPENSE at forcing the incompetent Brion Enterprises on you?
The U.S. Court of Appeals for the District of Columbia upheld the FCC s ruling that prohibited exclusivity agreements between cable companies and owners of apartment buildings and other multi-unit developments this past Tuesday. The opinion begins:
Finding that exclusivity agreements between cable companies and owners of apartment buildings and other multi-unit developments have an anti-competitive effect on the cable market, the Federal Communications Commission banned such contracts. The Commission believes that these deals which involve a cable company exchanging a valuable service like wiring a building for the exclusive right to provide service to the residents may be regulated under section 628 of the Communications Act as cable company practices that significantly impair the ability of their competitors to deliver programming to consumers. The Commission thus forbade cable operators not only from entering into new exclusivity contracts, BUT ALSO FROM ENFORCING OLD ONES.

Petitioners, associations representing cable operators and apartment building owners, argue that the Commission exceeded its statutory authority, arbitrarily departed from precedent, and otherwise violated the Administrative Procedure Act. Having carefully considered the parties excellent submissions, we disagree and conclude that the Commission acted well within the bounds of both section 628 and general administrative law.

There is no revenue sharing between Bent Tree Trails & Brion. There is also no exclusive agreement between Bent Tree Trails and Brion. Brion is the multi-family provider for our area as designated by DirecTV. Up until recently cable providers would not even talk to a community about providing service if a competing provider was also providing service to that property forcing the property owner to "pick one". DirecTV was the provider we picked based on resident interest. We have just recently had AT&T agree to even speak with us and we are in discussion with them so hopefully soon we will be able to offer both. This idea that Bent Tree Trails is making money off of television service is completely false and without any foundation. We have done the best we can in the climate we have had to deal with to provide the best options for our residents that we can. If you do not wish to take DirecTV from Brion you are welcome to use the FREE house antenna which was recently upgraded AT OUR EXPENSE to provide High-Def broadcasting.

Wait, I thought Bent Tree Trails never read this posting group. Isn't that what they told one poster? It is so hard to be a liar. So many lies to keep straight. RIGHT, Bent Tree Trails could have boosted the Moon Over Addison for their residents if they wanted. But that would have violated their agreement with Brion Enterprises. This law passed last fall. LAST FALL. It was affirmed recently but has been the law for quite a while. Bent Tree Trails got free wiring if they let Brion have the exclusive rights to service the complex. Bent Tree Trails would have you believe they received no benefit. They just forced you into shabby second rate services for the fun of it. OF COURSE, THEY HAVE A PECUNIARY BENEFIT IN CONTRACTING WITH BRION for THE EXCLUSIVE RIGHT TO SUPPLY DIRECT TV to the complex. Now they act like upgrading the free TV AT OUR EXPENSE is a big deal. What is and was NOT AT BTT's EXPENSE WAS THE WIRING OF THIS COMPLEX. That was free to BTT and the only price was paid by the renter.

BS on cable companies not wanting to talk to a complex if another provider is on property. I live across the tollway and we've had multiple options for at least five years. Cable companies want to make money. They aren't scared if they see another provider on property. I've had to beat ATT off with a stick, they've begged me to switch from Time Warner so often. And several neighbors have Dish or Direct TV.
