I just moved in to Wildwood Village a few weeks ago. I packed up a four bedroom house and moved in which was no easy task. The apartment complex would not let me see my exact apartment because it was not make-ready and that was against the law. When I got there, the apartment door was open, the fire alarms were off the wall, the entire place was so filthy and it was infested with roaches. There were roaches crawling on and in everything and when I say everything, I mean the seals in the refrigerator, the stove, the dishwasher, the sinks, every crack in the place. I went to complain and they told me they had just sprayed so it was bringing them out. I started to try and unpack and could not stop killing roaches long enough to do anything. After the whole day of moving, I went to the property manager and told her again what was going on and that I would and could not raise a child in this environment and/or live like this. The property manager came to walk the apartment and while she was there she let it slip that they knew about this problem on the Tuesday before I moved in and did not say a word to me before I moved in on Friday. She began to talk about credits $200-250 off of October rent and she would order new appliances because they were in them as well. She said we should move to the model (at this point we can barely lift ourselves much less our arms to move anything and all our heavy lifters and movers were gone) so we did. She confirmed there were some problem people living in this building and they needed to do something to take care of it. I told her I wanted to be transferred to another unit because those people were not going to change the way they lived and the problem would not go away. She asked if I would giver her a little time to try and correct it and she stated in front of me and my family that this was the first step and if this did not work, I could get out of this.
We moved to the model and the next day was the first day of school with everything in chaos, me changing bus schedules, directions for my son, just utter chaos. We stayed in the model for several days and my full-time job was staying on top of the property manager to make sure everything was happening because if I did not call every few hours or show up in person, nothing happened. I was consistently told one thing by her and then she would get in trouble with her supervisor and deny she ever offered anything or that she said anything. She is still doing that as of about two hours ago.
We finally moved back to the apartment and there were a still roaches crawling over everything. My husband is in the business of home remodeling and repair and he gave me industrial strength spray the day I moved in. I sprayed constantly, I have spent so much on roach bait, bombers and fumigators, and the roaches are worse than ever. I can not unpack anything, I can not cook, I am basically homeless. Over the holiday weekend I went looking for another apartment after a night of trying to go to bed and having roaches crawling on the ceiling and in my bed, my sons bed, and the only other thing to lay on was my couch which had roaches crawling out from under the cushions. We have had to leave the apartment, stay in hotels, stay on my sisters couch, etc... All the time communicating with the manager and having her lie to me. The exterminator was supposed to come again on Friday. He only did part of the living room and part of the kitchen, the rest of the apartment was left untouched.
One of the maintenance men in the apartments has confirmed where the roaches are coming from and that he pulled the appliances out for the exterminator to come to that apartment, they never came because they were never called. He has conformed that the apartment is absolutely filthy and that nothing is being done about it. He is having the same problem in his apartment and he has an 8 month old baby in his house who is playing with roaches. He is contemplating quitting his job and moving as soon as he can.
I wrote a letter on 1 September 2007 to the apartments quoting paragraph 31 on the TAA lease which states the rights of the tenant for Default by Owner. I explained in detail everything that I had been told, promised and what had not been delivered. I found another apartment and have been approved. I did not accept that apartment until after I spoke with the property manager, 4 September 2007, where she told me I was out of my lease, my credit would not be notified and she would give me a good reference. Today I received a call from the property manager after she got in trouble with her supervisor stating that she was going to pursue me for breaking my lease, that I did not give her enough time to fix this problem, that I should have let her move me to another unit (which I begged for in the beginning) as well as stating the credits she promised me (prorated rent when I have stayed in my apartment one night only, credit for consideration for all these unnecessary problems and deposits) are not available.
I called Texas Tenants Rights and they called me back and told me to call an attorney. I called TAA and they referred me to the Dallas Apartment Association who only takes complaints online which I filed. I asked what happened after that and they said all they could do was send the apartments a copy of my complaint. I called the Health Department and they said to call an attorney. I called Legal Aide of North Texas and they told me to stand in line and wait to fill out an application on the 13th of September and I might be considered. I then sent this letter to Channel 5 News Consumer Watch. BEWARE!!!!
